<br />receipt of which is hereby acknowledged, hereby grants and
<br />conveys unto the
<br />CITY OF GRAND ISLAND, NEBRASKA,
<br />a municipal corporation in Hall County, Nebraska, herein called
<br />the Grantee, a permanent and perpetual easement and right -of -way
<br />to construct, operate, maintain, extend, repair. replace, and
<br />remove public utilities, including but not limited to, sanitary
<br />sewers, pipelines, surface markers, and other appurtenances
<br />necessary for the operation and maintenance upon, in, above, and
<br />through a tract of land located in the Southeast Quarter of the
<br />Northwest Quarter (SE 1/4 NW 1/4) of Section Two (2), Township
<br />Eleven (11) North, Range Ten (10) west of the 6th P.M., Hall
<br />County, Nebraska, more particularly described as follows:
<br />Beginning at the Northwest corner of Lot Twenty -two
<br />(22) of the Capital Heights Eighth Subdivision; thence
<br />running easterly along the North line of said sub-
<br />division for a distance of one thousand two hundred
<br />forty -one and fifty -five hundredths (1,241.55) feet to
<br />the Northeast corner of Lot Twelve (12), Capital
<br />Heights Eighth Subdivision; thence running northerly
<br />along the West right -of -way line of Independence Avenue
<br />for a distance of eight (8) feet; thence running
<br />westerly along a line eight (8) feet North of and
<br />parallel to the North line of the Capital Heights
<br />Eighth Subdivision for a distance of one thousand two
<br />hundred forty -one and fifty -five hundredths (1,241.55)
<br />feet; thence running southerly eight (8) feet to the
<br />point of beginning, said tract containing 9,932.40
<br />square feet (0.228 acre), more or less, all as shown on
<br />the plat marked Exhibit "A ", attached hereto and
<br />incorporated herein by reference;
<br />together with the following rights, namely, unrestricted ingress
<br />and egress under and across such land for the purpose of
<br />exercising the rights herein granted, to clear and keep clear of
<br />trees, roots, brush, and other obstructions from the surface of
<br />such tract. Any such utilities and appurtenances placed upon and
<br />under such tract of land shall remain the property of the Grantee
<br />and may be removed or replaced at any time.
