I 140898 <br />R E S O L U T I O N. <br />s. <br />WHEREAS, James E. Ross and Janet M. Ross, husband and <br />d <br />wife, have requested deferral of assessment under Sanitary <br />Sewer Extension District No. 460 created by ordinance No. <br />7217 for certain land owned by them located in the Northeast <br />Quarter (NE 1/4) of Section 2, Township 11 North, Range 10 <br />r` <br />West of the 6th P.M., Hall County, Nebraska; and <br />WHEREAS, the City. Council finds that such land is <br />adjacent to the City of Grand Island,, zoned for agricultural <br />use, used exclusively for agricultural use, and more than <br />twenty acres in size; and <br />WHEREAS, the application for deferment is timely made <br />;;pursuant to Neb. R_R:S: 1.9 -2428; and <br />WHEREAS, the City Council finds that such application <br />should be granted. <br />NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL <br />OF THE CITY OF GRAND ISLAND, NEBRASKA: <br />I. The special assessment to be levied under Sanitary <br />,Sewer Extension District No. 460 against two tracts of lard <br />owned by James E.'Ross and Janet Pd_ Ross, being located 'n +.n <br />the West Half of the Northeast Quarter (W 1/2 NE 114) of <br />Section 2, Township 11 North, range 10 West of the 6th P.m,,, <br />in Hail County, Nebraska, more particularly described as <br />AN <br />follows- <br />Beginning at a point on the West line of said Northeast <br />�m - <br />Quarter (NE 1/4), said point being eight hundred <br />th_rty -two ( 832) feet *forth of the Southwest corner of <br />said Northeast Quarter (NE 1/4), also being the <br />Northwest corner of.Lot 13 of Ross Heights Second <br />: Subdivision, - ,thence northerly along the West line of <br />-, said ,Northeast Quarter (NE 1/4) to the southerly <br />rig3Tt -of -way line of Nebraska Highway No. 2; thence <br />southeasterly along said southerly right -of -way line to . <br />the Northeast corner of Lot 1 of Ross- Theasmeyer <br />Subdivision; thence running southerly along the West <br />line of Ross Theasmeyer Subdivision to the Northeast <br />..;corner of Lot 8 of Ross...Heights Second Subdivision;.. <br />thence running wester -4y along the NortQ fine of Ross <br />- <br />Heights second Subdivision to the paint of beginning, <br />said tract containing 16 acres, more or less; <br />.i <br />and <br />Starting at the Southeast corner of said West Half of <br />the Northeast Quarter (W 1/2 ATE 1/4); thence running <br />northerly along the East line of said West Half of the <br />Northeast Quarter (4: 1/2 NE 114) a distance of eight <br />`. <br />hundred fifty -nine and sixty -nine hundredths (854.69) <br />feet to the actual point of beginning, this point also <br />being the Northeast corner of Lot 22 of Ross- Theasmeyer <br />Subdivision, thence running 'northerly along the 'East <br />line of the West Half of the Northeast Quarter (W 112 ` <br />NE 1/4) to a point on the southerly right -of -way line <br />of Nebraska Highway No. 2, thence running northwesterly <br />along said right- of-way line of Nebraska Highway No. 2 <br />to the East right -of -way 'line of Idaho Avenue; thence <br />running southerly along said right -of -way line of Idaho <br />Avenue to the Northwest corner of Lot 23 cf Ross- <br />-PROVED OED AS TO FORt.- � <br />
