SHERIFF'S DEED
<br />AND BILL OF SALE 87-10o399
<br />KNUW ALL MEN BY THESE PRESENTS:
<br />THAT WHEREAS, in an action in the District Court of Hall County, Nebraska,
<br />wherein JOHN HANCOCK MUTUAL LIFE INSURANCE COMPANY, a Corporation, Plaintiff, and
<br />BER4ARD C. HARDERS, et al, Defendants, did on February 28, 1986, obtain a decree find-
<br />ing there to be due the sun of $262,301.00 and costs of the suit, and, whereas, it was
<br />further ordered that in default of the payment of the sum so found due that the Sheriff
<br />of Hall County should cause the lands, tenements, and personal property hereinafter
<br />described to be advertised and sold according to law to pay the same, aril, whereas,
<br />default having been made therein, the said Sheriff of said County, under and by virtue
<br />of the said decree and the order of sale to him duly directed, did on the 7th day of
<br />January, 1.987 at the Court Haase in the City of Grand Island, in said County and State,
<br />having first given due and legal notice of the time and place of said sale once each
<br />week for four (4) successive weeks in the Grand Island Daily Independent, a newspaper,
<br />printed and in general circulation in said County, sell said real and personal property
<br />at public auction to JOHN HANCOCK MUTUAL LIFE INSURANCE COMPANY, a Corporation, for the
<br />sun of $240,000.00, which sale was afterwards on January 23, 1987, examined and con -
<br />firmed by the said Court and the said Sheriff ordered to convey and transfer the said
<br />real and personal property to the said JOHN HANCOCK MUTUAL LIFE INSURANCE COMPANY, a
<br />Corporation.
<br />NOW THEREFORE, I the said Charles F. Fairbanks, Sheriff of Hall County, as
<br />aforesaid, in consideration of the premises and by virtue of the powers vested in me by
<br />law and the decree of said Court, do hereby bargain, grant, transfer and convey to the
<br />said JOHN HANCOCK MUTUAL LIFE INSURANCE COMPANY, a Corporation, its successors and
<br />assigns, the following described real estate and personal property, to-wit:
<br />Northeast Quarter (NE3;) of Section Five (5) and the South Half (SY of the
<br />Southeast Quarter (SE;) and the Northeast Quarter (NE4) of the Southeast
<br />Quarter (SE's) of Section Sixteen (16) , in Township Eleven (11) North, Range
<br />Eleven (11), West of the 6th P.M., Hall County, Nebraska
<br />EXCEPT a tract of land located in the East Half (EM of the Southeast Quarter
<br />(SEa) of Section Sixteen (16), Township Eleven (11) North, Range Eleven (11),
<br />West of the 6th P.M., more particularly described as follows:
<br />Beginning at a point on the east line of said Section Sixteen (16), said point
<br />being 971.85 feet south of the northeast corner of said Southeast Quarter
<br />(SE;); thence southerly along the east line of said Section Sixteen (16), a
<br />distance of 627.0 feet; thence deflecting right 90 000' and running westerly a
<br />distance of 330.0 feet; thence northerly parallel. to the east line of said
<br />Section Sixteen (16), a distance of 627.0 feet; thence deflecting right 90 °00'
<br />and running easterly, a distance of 330.0 feet to the place of beginning and
<br />containing 4.750 acres, more or less,
<br />Together with all irrigation wells, pumps, engines, motors, pipes, casings,
<br />gearheads, equipment and all appurtenances and any substitute or replacement
<br />thereof thereunto now or hereafter placed on the above described land, includ-
<br />ing without limitation the following:

<br />together with all hereditaments and appurtenances.
<br />TO HAVE AND TO HOLD THE SAME unto the said JOHN tiANCOCK MUTUAL LIFE INSURANCE
<br />COMPANY, a Corporation, its successors and assigns, and to it and their use forever.
<br />This instrument transfers to the grantee the personal property above- escribed.
