ELECTRICAL EASEMENT 100878
<br />WAEELF.R FAR!( SUPPLY CO. OF GRAND ISLAND, a Nebraska Corporation; now
<br />known as CONhAGRA, INC., a Delaware Corporation; herein called Grantor, in
<br />consideration of One Dollar ($1.00) , receipt of which is hereby
<br />acknowledged, hereby grants and conveys unto the
<br />CITY OF GRAND ISLAND, NEBRASKA,
<br />a municipal corporation in Hall County, Nebraska, herein called Grantee, a
<br />permanent and perpetual easement and right-of -way to survey, construct,
<br />inspect, maintain, repair, replace, extend, remove, and operate thereon,
<br />underground electrical utility lines, cables, terminals, transformers, surface
<br />markers, and other appurtenances connected therewith, in, upon, above, along,
<br />across, underneath, and through a sixteen (16.0) foot square tract of land
<br />located in part of Lot Eleven (11), Block One (1), Nelsen Second Subdivision,
<br />Grand Island, Hall County, Nebraska; the centerline of the easement tract
<br />being more particularly described as follows:
<br />Commencing at the intersection point of the North line of
<br />fractional Section Nineteen (19), Township Eleven (11)
<br />North, Range Nine (9) West, and the East right -of -way line
<br />of Webb Road; thence Southerly along the East right -of -way
<br />line of Webb Road and its extension, a distance of two
<br />hundred and seven tenths (200.7) feet to the actual point of
<br />beginning; thence Easterly, perpendicular to the said East
<br />right -of -way of Webb Road, a distance of sixteen (16) feet.
<br />The above described tract of land containing 256 square
<br />feet, more or less as shown on the plat dated 8/14/86,
<br />marked Exhibit "A ", attached hereto, and incorporated herein
<br />by reference;
<br />together with the following rights:
<br />Unrestricted ingress and egress to the above described easement tract for
<br />the installation, maintenance, operation, and removal of such underground
<br />electrical utilities and appurtenances.
<br />Such rights of ingress and egress shall include all rights necessary for
<br />the full and complete use, occupation, and enjoyment of the easement herein
<br />g ranted, including the right to excavate and refill ditches and trenches; to
<br />move, clear, and keep clear trees, bushes, hedges, undergrowth, and other
<br />obstructions interfering with the surveying, construction, inspection,
<br />maintenance, repair, replacement, extension, removal, or operation of such
<br />underground electrical utilities and appurtenances. No structures, buildings,
<br />fences, or other obstructions of any kind whatsoever, shall be allowed in,
<br />upon, above, along, across, underneath, or through the easement herein
<br />granted; other than the existing fence and asphalt paving, as they are
<br />presently located.
<br />The Grantor and Grantee hereto agree that the Grantor may continue to use
<br />the easement area herein granted for any use permitted by law, that does not
<br />interfere with the operation and maintenance of the underground electrical
<br />utilities and appurtenances constructed therein.
<br />All electrical utility lines, cables, terminals, transformers, surface
<br />markers, and other appurtenances connected therewith, placed in, upon, above, J
<br />along, across, underneath, and through such easement tract shall remain the
<br />property of the Grantee, and may be removed or replaced at any time.
