87-- 100829 <br />SURVIVORSHIP WARRANTY DEED <br />1. The City of Grand Island, Nebraska, by action of its <br />City Council on December 1, 1986, enacted Ordinance No. 7312 <br />which directed the conveyance of the real estate described below <br />and the manner and terms thereof. <br />2. Ordinance No. 7312 was published in the Grand Island <br />Daily Independent according to law on December 8, 1986, and <br />immediately thereafter notice of such sale and the terms thereof <br />were published in the Grand Island Daily Independent for three <br />consecutive weeks, on December 9, December 16, and December 23, <br />1986, all as required by Section 16 -202, R.R.S. 1943. <br />3. No remonstrance against such sale was filed with the <br />City Council of the City of Grand Island, Nebraska, within <br />thirty days of the passage and publication of such Ordinance No. <br />7312. <br />4. Section 5 of,Ordinance No. 7312 provides that if no <br />remonstrance be filed against such conveyance, the mayor and <br />city clerk - finance director shall make, execute, and deliver to <br />the Grantees a surviviorship warranty deed for said real estate, <br />and the execution of such surviviorship warranty deed is hereby <br />authorized without further action on behalf of the city council. <br />NOW, THEREFORE, the City of Grand Island, Nebraska, a <br />municipal corporation in Hall County, Nebraska, as Grantor, in <br />consideration of Eighteen Thousand Dollars ($18,000.00) received <br />from Grantees, does hereby grant, bargain, sell, convey, and <br />confirm unto <br />PATRICK FILLINGER and THERESA A. SMITH, <br />as joint tenants and not as tenants in common, with right of <br />survivorship, herein called the Grantees, the following <br />described real property in Hall County, Nebraska: <br />The North Half (N 1/2) of Lot One (1), and the North <br />Half (N 1/2) of Lot Two (2), Block Eighteen (18), <br />Original Town, now City of Grand Island, Hall County, <br />Nebraska. <br />To have and to hold the above described premises, together <br />with all tenements, hereditaments and appurtenances thereto <br />belonging unto the Grantees and to Grantees' heirs, devisees, <br />executors, administrators, successors, and assigns forever. <br />M1 <br />
