<br />SPECIAL WARRANTY DEED
<br />
<br />ALLEN PHASE III LLC, a Nebraska limited liability company, GRANTOR, in consideration of One
<br />Dollar ($1.00) and other valuable consideration received from BRIAN 1. McMAHON and LORI A. McMAHON,
<br />husband and wife, as tenants in common, collectively GRANTEE, conveys to GRANTEE the following-described
<br />real estate (as defined in Neb. Rev. Stat. S 76-201) in Hall County, Nebraska:
<br />
<br />Lot Thirteen (13), Meadowlark West Fourth Subdivision,
<br />City of Grand Island, Hall County, Nebraska.
<br />
<br />GRANTOR covenants with GRANTEE that GRANTOR:
<br />
<br />(1) is lawfully seized of such real estate and that it is free from encumbrances, except (i)
<br />easements, restrictions, covenants, declarations, reservations and conditions of record; (ii)
<br />the lien of current real estate taxes which have been apportioned; (iii) that certain
<br />Declaration of Restrictions and Grant of Easements dated March 11, 1999, and recorded
<br />on June 24, 1999, as Instrument No. 99-106376; (iv) that certain ECR Declaration dated
<br />December 10, 2003, and recorded on December 17, 2003, as Instrument No. 200316111;
<br />(v) that certain Roadway Easement Declaration dated March 18, 2005, and recorded on
<br />March 23, 2005, as Instrument No. 200502514; (vi) that certain Utility Easement dated
<br />June 17, 2005, and recorded June 29, 2005, as Instrument No. 200505870; (vii) that
<br />certain Utility Easement dated February 19,2007, and recorded on February 28, 2007, as
<br />Instrument No. 200701514; (viii) that certain Covenant Regarding Certain Uses dated
<br />March 11, 1999, and recorded on June 24, 1999, as Instrument No. 99-106378; (ix) that
<br />certain Subdivision Agreement for Meadowlark West Third Subdivision recorded on
<br />June 24, 1999, as Instrument No. 99-106354; (x) that certain Subdivision Agreement for
<br />Meadowlark West Fourth Subdivision recorded June 12, 2002, as Instrument No.
<br />200206261; and (xi) that certain Restrictive Use Agreement dated January 18, 2005, and
<br />recorded on January 20,2005, as Instrument No. 200500547;
<br />
<br />(2) has legal power and lawful authority to convey such real estate; and
<br />
<br />(3) warrants and will defend title to the real estate against the lawful claims of all persons
<br />claiming the same or any part thereof by, through or under GRANTOR.
