Depue, a <br />member of the Nebraska State Bar Association and Trustee, upon a <br />Deed of Trust made and entered into on or about December 12, 2005, <br />by and between Jason Lawhorne and Deanna Lawhorne, husband and <br />wife, Trustor, and J&B Rentals, LLC, a Nebraska limited liability <br />company, Beneficiary, and Ronald S. Depue, Trustee, which Deed of <br />Trust was filed on December 14, 2005, in the Register of Deeds <br />office of Hall County, Nebraska, as Document No. 200512218, herein <br />called the Grantor, in consideration of Twenty Thousand Dollars <br />($20,000.00), received from Grantee, does hereby grant, bargain, <br />sell, convey and confirm unto J&B Rentals, LLC, herein called the <br />Grantee, the following described real property in Hall County, <br />Nebraska: <br /> <br />-...........- <br /> <br />C:;) <br /> <br />\~'\. <br />C:: <br /> <br />The North 64 Feet of Lot Four (4), Block Twenty-seven <br />(27), Original Town, now City of Grand Island, Hall <br />County, Nebraska. <br /> <br />TO HAVE AND TO HOLD the above described premises together with <br />all tenements, hereditaments, and appurtenances thereto belonging <br />and to the Grantee. <br /> <br />Grantor does hereby covenant with Grantee as follows: <br /> <br />1. That Jason Lawhorne and Deanna Lawhorne, husband and <br />wife, Trustor, failed to pay the Beneficiary payments which were <br />contractually due and the Grantor, at the request of the Beneficia--- <br />ry, elected to declare the entire unpaid principal balance together <br />with interest thereon at once immediately due and payable; <br /> <br />2. That a notice of default was filed by Grantor on December <br />13, 2007, in the Register of Deeds office of Hall County, Nebraska, <br />as Document No. 200710381. A copy of the notice of default was <br />served upon Jason Lawhorne and Deanna Lawhorne, Trustor, by <br />certified mail, postage prepaid on December 18, 2007, and by first- <br />class mail on January 9, 2008; <br /> <br />3. The Trustor, Jason Lawhorne and Deanna Lawhorne, husband <br />and wife, failed to cure the default referenced in the notice of <br />default within thirty days after the service of the notice of <br />default; <br />
