GALLES, is the <br />Successor Trustee under a Deed of Trust made and entered into on or about November 7,2005, by <br />and between DAVID K. SORENSEN and MELISSA A. SORENSEN, husband and wife, <br />Trustors, and U.S. BANK TRUST COMPANY, NATIONAL ASSOCIATION, Trustee, <br />MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC. as Nominee for Charter <br />West National Bank, Beneficiary. Said Deed of Trust was recorded on November 7, 2005 as <br />Instrument No. 2005-11047 of the Mortgage Records of Hall County, Nebraska. Said Deed of Trust <br />having been assigned by virtue of an Assignment dated July 27,2007 to U.S. BANK, N.A., and <br />which was filed for record on August 13, 2007 as Instrument No. 2007-06893 of the Mortgage <br />Records of Hall County, Nebraska. GREGORY L. GALLES was appointed Successor Trustee by <br />virtue ofa Substitution of Trustee dated August 31, 2007, and recorded September 19, 2007, as <br />Instrument No. 2007-08083 in the Office of the Register of Deeds for Hall County, Nebraska. <br />GREGORY L. GALLES, Grantor, in consideration of the sum of Sixty-Three Thousand Five <br />Hunared Ninety-Two and 82/100 ($63,592.82) and other good and valuable consideration received <br />from U.S. BANK, N.A., does hereby grant, bargain, sell, convey and confirm unto U.s. BANK, <br />N.A., (hereinafter "Grantee" where appropriate), the following-described real property in Hall <br />County, Nebraska, to wit: <br /> <br />The Easterly 50 feet of the Westerly 198 feet of Fractional Block 17 in <br />Windolph Addition to the City of Grand Island, Hall County, Nebraska, <br /> <br />to have and to hold the above-described premises together with all tenements, hereditaments and <br />appurtenances thereunto belonging unto the Grantee and to Grantee's successors and assigns forever. <br />Grantor does hereby covenant with Grantee and Grantee's successors and assigns: <br /> <br />1. That DAVID K. SORENSEN and MELISSA A. SORENSEN, as Trustors, failed to pay to <br />Beneficiary payments which were contractually due, and the Grantor, at the request of the <br />Beneficiary, elected to declare the entire unpaid principal balance, together with interest <br />thereon at once immediately due and payable. <br /> <br />2. That David K. Sorensen and Melissa A. Sorensen filed their Chapter 7 Bankruptcy Petition <br />on August 30, 2007 and U.S. Bank, N.A. obtained relief from the Bankruptcy Stay on <br />October 26,2007. <br /> <br />3. That a Notice of Default as required by S 76-1006 was filed by Grantor on November 19, <br />2007, as Instrument No. 2007-09822 of the Miscellaneous Records in the office of the <br />Register of Deeds of Hall County, Nebraska. A copy of said Notice of Default was thereafter <br />mailed to all parties entitled to notice, pursuant to said Deed of Trust and in compliance with <br />S 76-1008, R.R.S. Nebraska. <br /> <br />4. That the Trustor failed to cure the default referenced in the Notice of Default within 30 days <br />after filing of the Notice of Default. <br /> <br />5. That a Notice of Trustee's Sale was filed by Grantor on January 7,2008, as Instrument No. <br />2008-00144 of the Miscellaneous Records in the office of the Register of Deeds of Hall <br />County, Nebraska. A copy of said Notice of the time and place of the sale was thereafter <br />mailed to all parties entitled to notice pursuant to said Deed of Trust and in compliance with <br />* 76-1008, R.R.S. Nebraska. <br />
