<br />THIS DECLARATION OF ACCESS EASEMENT is made this 21st day of
<br />February ,2008, by ALLEN PHASE JTJ LLC, a Nebraska limited liability company
<br />(hereinafter referred to as "Declarant").
<br />
<br />WIT N E SSE T H:
<br />
<br />Declarant was and is the record owner of Lots I and 2, Meadowlark West Fifth
<br />Subdivision, in the City of Grand Island, Hall County, Nebraska (herein individually "Lot 1" and
<br />"Lot 2" and collectively the "Property" or "Properties"). Declarant desires to establish a
<br />perpetual nonexclusive easement for vehicular and pedestrian ingress, egress, passage and traffic
<br />access over portions of Lot 2 that do not contain building or other commercial structures, and
<br />more specifically located, described and substantially pictorially depicted on Exhibit "A"
<br />attached hereto, for the purpose of providing nonexclusive access to and from Lot 1 and adjacent
<br />public and private drives and streets and to Allen Drive and Faidley A venue (herein the
<br />"Easement").

<br />The Declarant hereby establishes the Easement as follows:
<br />
<br />1. Easement. The Declarant grants a perpetual nonexclusive easement for access
<br />over portions of Lot 2 that do not contain a building or other commercial structures, and more
<br />specifically located, described and substantially pictorially depicted on Exhibit "A" for the
<br />purpose of providing vehicular and pedestrian ingress, egress, passage and traffic access to and
<br />from Lot 1 and adjacent public and private drives and streets and to Allen Drive and Faidley
<br />Avenue. The Declarant, the owner of Lot 1, and their respective successors, assigns, guests,
<br />occupants, invitees, tenants, subtenants, customers, employees, servants, licensees, agents and
<br />contractors are benefited parties and permittees with respect to this Easement (collectively the
<br />"Permittees").
