<br />TRUSTEE'S DEED
<br />
<br />KNOW ALL MEN BY THESE PRESENTS that GREGORY L. GALLES, is the J /. () 0
<br />Successor Trustee under a Deed of Trust made and entered into on or about September 15, 2005, by
<br />and between KELLY STOWELL a/k/a KELL Y R. STOWELL and RENATA D. STOWELL,
<br />husband and wife, Trustors, and U.S. BANK TRUST COMPANY, N.A., Trustee, HOME
<br />FEDERAL SAVINGS AND LOAN ASSN. OF GRAND ISLAND, Beneficiary. Said Deed of
<br />Trust was recorded on September 16,2005 as Instrument No. 2005-09131 of the Mortgagc Records
<br />of Hall County, Nebraska. Said Deed of Trust having been assigned by virtue of an Assigmnent
<br />dated September 15,2005 to U.S. BANK, N.A., and which was filed for record on October 31,2005
<br />as Instrument No. 2005-10781 of the Mortgage Records of Hall County, Nebraska. GREGORY L.
<br />GALLES was appointed Successor Trustee by virtue of a Substitution of Trustee dated October 19,
<br />2007, and recorded October 30, 2007, as Instrument No. 2007-09281 in the Office of the Register of
<br />Deeds for Hall County, Nebraska. GREGORY L. GALLES, Grantor, in consideration of the sum
<br />of One Hundred Twenty-Three Thousand Four Hundred Ninety-Nine and 21/100 ($123,499.21) and
<br />other good and valuable consideration received from U.S. BANK, N.A., does hereby grant, bargain,
<br />sell, convey and confirm unto u.S. BANK, N.A., (hereinafter "Grantee" where appropriate), the
<br />following-described real property in Hall County, Nebraska, to wit:
<br />
<br />Lot Two (2) and the Northerly Thirteen (13) feet of Lot Four (4), in Block
<br />Fourteen (14), in Scarffs Addition to West Lawn, as surveyed, platted
<br />and recorded :in the City of Grand Island, Hall County, Nebraska.
<br />
<br />to have and to hold the above-described premises together with all tenemcnts, hereditaments and
<br />appurtenances thereunto belonging unto the Grantee and to Grantee's successors and assigns forever.
<br />Grantor does hereby covenant with Grantee and Grantee's successors and assigns:
<br />
<br />1. That KELLY STOWELL a/k/a KELLY R. STOWELL and RENATA D. STOWELL,
<br />as Trustors, failed to pay to Beneficiary payments which were contractually due, and the
<br />Grantor, at the request of the Beneficiary, elected to declare the entire unpaid principal
<br />balance, together with interest thereon at once immediately due and payable.
<br />
<br />2. That a Notice of Default as required by S 76-1006 was filed by Grantor on October 30, 2007,
<br />as Instrument No. 2007-09282 of the Miscellaneous Records in the office ofthe Register of
<br />Deeds of Hall County, Nebraska. A copy of said Notice of Default was thereafter mailed to
<br />all parties entitled to notice, pursuant to said Deed of Trust and in compliance with S 76-
<br />1008, R.R.S. Nebraska.

<br />3. That the Trustor failed to cure the default referenced in the Notice of Default within 30 days
<br />after filing of the Notice of Default.
<br />
<br />4. That a Notice of Trustee's Sale was filed by Grantor on December 17,2007, as Instrument
<br />No. 2007-10465 of the Miscellaneous Records in the office of the Register of Deeds of Hall
<br />County, Nebraska. A copy of said Notice of the time and place of the sale was thereafter
<br />mailed to all parties entitled to notice pursuant to said Deed of Trust and in compliance with
<br />S 76-1008, R.R.S. Nebraska.

<br />5. That Grantor as required by S 76-1007 published a Notice of Trustee's Sale to be held on
<br />January 29,2008, at 10:00 a.m. in the lowerlobbyofthe Hall County Courthouse, 111 West
<br />First Street, Grand Island, Nebraska. Said Notice was published in the Grand Island e ()
<br />Independent, a legal newspaper of Grand Island, Hall County, Nebraska, once, a week for fi ve ~+ (
