""'0 !::''lro- en <br />r-q :::3 , ,:',':J <br />~:,J ~ .-- )>. <br />(f) en <br /> c.J ?': <br /> l> <br /> r',) ---' ---- <br /> Ul en <br /> (f) <br /> <br /> <br />~ <br /> <br />Tract Number: NE-HAL-007 <br /> <br />PIPELINE EASEMENT <br /> <br />KNOW ALL MEN BY THESE PRESENTS: <br /> <br />That The Estate of Jerome Niedfelt, Deceased, whose address is 1515 Husker Hwy, Grand Island, <br />Nebraska 68801, ("Grantor"), for themselves, their heirs, successors and assigns, for and in consideration <br />of the sum of Ten Dollars ($10.00) and other valuable consideration, the receipt and adequacy of which is <br />hereby acknowledged, do(es) hereby grant, convey, confirm and warrant unto Kinder Morgan Interstate <br />Gas Transmission LLC , a Colorado limited liability company, whose address is 370 Van Gordon, <br />Lakewood, CO 80228, its successors and assigns ("Grantee"), a permanent easement and temporary <br />easements, as depicted on Exhibit A attached hereto and made a part hereof (collectively referred to as <br />the "Easements") to survey, construct, reconstruct, maintain, operate, alter, protect, inspect, move, renew, <br />repair, remove, replace, test change the size of, upgrade, abandon in place and remove a natural gas <br />pipeline and all related above and below ground appurtenances including but not limited to cathodic <br />protection (collectively the" Pipeline"), in, on, over, under, across, upon and through the following <br />described property situated in the County of Hall, State of Nebraska, to wit: <br /> <br />The Southeast Quarter of the Northeast Quarter ~SE% NE%) of Section Thirty-six (36), Township <br />Eleven (11) North, Range Nine (9), West of the 6 h P.M., Hall County, Nebraska. <br /> <br />The Grantor reserves the right to cultivate, use and occupy said property for any purpose consistent with <br />the rights and privileges herein granted and, in the sole opinion of the Grantee, which will not interfere with <br />or endanger any of the Pipeline facilities therein or use thereof by the Grantee, its agents or contractors. <br />Grantor shall not construct any buildings or structures, impound any water, or plant any trees or shrubs <br />upon the permanent easement. The Grantee, at all times, shall have the perpetual right of ingress and <br />egress over the permanent easement and the adjacent and contiguous properties of the Grantor at <br />convenient points in order that the Grantee may access its permanent easement. <br /> <br />The permanent easement shall be in perpetuity. The temporary easements and additional work space <br />easements shall expire upon completion of the pipeline construction and restoration of the Easement. <br /> <br />Grantee agrees that the Pipeline will be constructed with at least 36" of soil cover.
