<br />
<br />WHEREAS, Linden Tumoff Road is a private road situated III the City of Grand Island, Hall County,
<br />Nebraska; and
<br />
<br />WHERI~AS, Steven F. Sorahan and Deborah L. Sorahan, husband and wife, are the owners of property
<br />situated in the City of Grand Island, Hall County, Nebraska commonly known as 557 Linden Avenue, and described as
<br />follows:

<br />Part of the Northwest Quarter of the Southeast Quarter (NWY4, SEY4) of Section Thirteen (13), Township Eleven (II)
<br />North, Range Nine (9) West of the 6th P.M., Hall County, Nebraska, more particularly described as follows: Beginning

<br />WHERE:AS, the parties hereto own adjoining property and have the right of enjoyment of Linden Turnoff
<br />Road for purposes of ingress and egress, which is described as follows:

<br />That roadway adjacent to and/or abutting the three properties described above;

<br />WH EREAS, the parties desire to enter into an Agreement regarding the costs of maintenance and
<br />improvements to Linden TurtloffRoad;
<br />
<br />NOW TI-IEREFORE, IT IS HEREBY AGREED AS FOLLOWS:

<br />1. Road Mainten;!l1ce. Road Maintenance and road improvements will be incurred whenever necessary to
<br />maintain the unpaved portion of the road in top operating condition at all times and to insure the provision of safe access
<br />by vehicles. All road maintenance and road improvements shall be performed in accordance with the standards set forth
<br />in any existing Hall County Ordinances as well as any other applicable statutes and ordinances. A majority of all parcel
<br />owners is required for any road improvements and to accept the bid of any road improvement contractor.
