<br />WHEREAS, the within named Grantor is the Trustee under the terms of a certain Deed of
<br />Trust dated February 7, 2005, and filed for record with the Hall County Register of Deeds on
<br />February 8, 2005, as Instrument No. 200501108 as modified by Modifications of Deed of Trust
<br />dated August 31, 2005, filed for record in the office of the Register of Deeds of Hall County,
<br />Nebraska, on September 1, 2005, as Instrument No. 200508630 and on September 19, 2005, as
<br />Instrument No. 200509287 which, after the Partial Release of Deed and Reconveyance filed of
<br />record in the office ofthe Register of Deeds of Hall County, Nebraska on September 1,2005, as
<br />Instrument No. 200508632 wherein James A. Martinez, a Single Person was Trustor;
<br />
<br />WHEREAS, said Trustee has upon default of the Trustors of the obligations contained in
<br />such Deed of Trust caused such Notice of Default and Notice of Sale to be filed, given and
<br />published as required by Nebraska Trust Deeds Act contained in Chapter 76, Article 10, of the
<br />Nebraska Trust Deeds Act;
<br />
<br />WHEREAS, a public sale of the real estate hereinafter described was conducted on the
<br />date and at the time and place designated in the Notice of Sale; and
<br />
<br />WHEREAS, the within named Grantee offered the highest bid at such public auction.
<br />
<br />NOW, THEREFORE, PLATTE VALLEY STATE BANK & TRUST COMPANY,
<br />Trustee under a certain Deed of Trust dated February 7, 2005, and filed for record with the Hall
<br />County Register of Deeds on February 8, 2005, as Instrument No. 200501108 as modified by
<br />Modifications of Deed of Trust dated August 31, 2005, filed for record in the office of the
<br />Register of Deeds of Hall County, Nebraska, on September 1, 2005, as Instrument No.
<br />200508630 and on September 19, 2005, as Instrument No. 200509287 which, after the Partial
<br />Release of Deed and Reconveyance filed of record in the office of the Register of Deeds of Hall
<br />County, Nebraska on September 1,2005, as Instrument No. 200508632, herein called the
<br />Grantor, for and in consideration of the sum of Seven Hundred Five Thousand and Noll 00
<br />Dollars ($705,000.00) received from Grantee does hereby quitclaim, grant, bargain, sell, convey
<br />and confirm unto BPW, INC. herein called the Grantee, the following-described real estate in
<br />Hall County, Nebraska:

<br />Lot 2, Toukan Fourth Subdivision, in the City of Grand Island, Hall County,
<br />Nebraska
<br />
<br />TO HAVE AND TO HOLD the premises above described, together with all the build-
<br />ings, improvements, hereditaments and appurtenances thereunto belonging, unto the said Grantee
<br />and to Grantee's heirs, successors and assigns forever.
