<br />NOTICE IS HEREBY GIVEN THAT pursuant to a Real Estate Purchase Agreement dated
<br />February 1, 2008, between Emmett Quaring, a single person, hereinafter referred to as "Seller",
<br />whether one or more, and James R. Ford, and his assigns, hereinafter referred to as "Buyer",
<br />whether one or more, the Seller has agreed to sell and convey to the Buye." and the Buyer has agreed
<br />to purchase from the Seller the following described real property:

<br />The Northeast Quarter (NE~) of Section Thirty (30), Township Twelve (12)
<br />North, Range Twelve (12) West of the 6th P.M., Hall County, Nebraska,
<br />EXCEPT a tract of land more particularly described as follows: Beginning at
<br />the northwest corner of said Northeast Quarter (NE~), said point being the
<br />ACTUAL point of beginning; thence running on an Assumed Bearing of
<br />S90000'00''E along the north line of said Northeast Quarter (NEY-a), a distance
<br />of One Thousand Two Hundred Eighty-two and Forty-nine Hundredths
<br />(1,282.49) feet; thence running SOooOO'OO"E, a distance of Fifty-five and Eighty~
<br />five Hundredths (55.85) feet; thence running southwesterly along the arc of a
<br />1,291.00 foot radius circle to the left with a chord bearing of S67000'39"W and
<br />a chord length of One Thousand Eight and Forty-three Hundredths (1,008.43)
<br />feet; thence running S46058'43"E, on a radial line of said 1,291.00 foot radius
<br />circle, a distance of Sixty (60.00) feet; thence running S39001 '20"W, a distance
<br />of Two Hundred Fourteen and Fifty-four Hundredths (214.54) feet; thence
<br />running N55056'37"W, on a radial line of said 1,291.00 foot radius circle, a
<br />distance of Sixty (60.00) feet; thence running southwesterly along the arc of a
<br />1,291.00 foot radius circle to the left with a cord bearing of SI7040'19"W and
<br />a chord length of Seven Hundred Twenty-six and Nine-tenths (726.90) feet;
<br />thence running N88040'46"W, a distance of Twenty~two and Nineteen
<br />Hundredths (22.19) feet, to a point on the west line of said Northeast Quarter
<br />(NEV.) a distance of One Thousand Three Hund.ed Sixteen and Ninety-four
<br />Hundredths (1,316.94) feet, to the ACTUAL point of beginning (said exception
<br />containing 10.39 acres, more or less).

<br />This Memorandum of Real Estate Purchase Agreement is being recorded in the Office of the
<br />Register of Deeds of Hall County, Nebraska, in order to protect the rights of the parties hereto.
<br />Under the terms and conditions of paragraph 3 of said Real Estate Purchase Agreement, closure shall
<br />be within one hundred (100) days after the death of the Seller and as mutually agreed upon by the
<br />parties, but is subject to being delayed under the terms and conditions of paragraph 5 of said Real
<br />Estate Purchase Agreement.

<br />This Memorandum of Real Estate Purchase Agreement supersedes and makes null and void
<br />and of no further force and effect the Notice and underlying agreement between the parties that was
<br />recorded of record in the Office of the Hall County Register of Deeds on March 31, 2003 as
<br />Instrument No. 0200303712.
