Gloes and Trustee Alexander shall forthwith execute, <br /> <br />acknowledge and deliver to TNC, c/o its attorney of record in the <br /> <br />Boundary Line Suit, Patrick J. Nelson, a quitclaim deed in the form <br /> <br />and content of that, a copy of which is attached hereto, marked as <br /> <br />Exhibit "B", and by this reference incorporated herein. TNC shall <br /> <br />forthwith, upon such delivery, cause such deed to be filed for <br /> <br />record in the office of the Register of Deeds of Hall County, <br />Nebraska. <br />6. Gloes and Trustee Alexander shall forthwith date and <br /> <br />execute, cause their attorney of record in the Boundary Line Suit, <br /> <br />Larry R. Baumann, to date and execute, and deliver to TNC, c/o its <br /> <br />attorney of record in the Boundary Line Suit, Patrick J. Nelson, a <br />dismissal without prejudice in the form and content of that, a copy <br />of which is attached hereto, marked as Exhibit "C", and by this <br /> <br />reference incorporated herein. TNC shall forthwith, upon such <br /> <br />delivery, cause such dismissal to be filed with the Clerk of the <br /> <br />District Court of Hall County, Nebraska, in the Boundary Line Suit. <br /> <br />7. This Agreement constitutes the entire agreement between <br /> <br />the parties, covering everything agreed upon or understood in the <br /> <br />transaction. There are no oral promises, conditions, <br /> <br />representations, understandings, interpretations, or terms of any <br /> <br />kind as conditions or inducements to the execution hereof, or in <br /> <br />5 <br />
