Spiehs, Trustee of the Donald R. Spiehs Revocable Living Trust, and Beulah G. Spiehs, <br />Trustee of the Beulah G. Spiehs Revocable Living Trust, Grantors, and Family Worship Center <br />Church, Inc., Grantee. <br /> <br />WITNESSETH: <br /> <br />WHEREAS, the Grantors are seised of an estate in fee simple of a parcel of land described <br />on Exhibit "A" as parcel #1; and <br /> <br />WHEREAS, the Grantee is seised in fee simple of another parcel of land near the Grantors' <br />land, described on Exhibit "B" as parcel #2; and <br /> <br />WHEREAS, the Grantors have agreed, in consideration of Ten Dollars ($10.00) and other <br />good and valuable consideration to grant to the Grantee an easement for right-of-way over the real <br />estate owned by Grantors, more particularly described as follows, to wit: <br /> <br />A Ten (10.0) foot wide easement situated a part of the South Half of the Southwest <br />Quarter (S l/2SWl/4) of Section thirty-four (34), Township Ten (10) North, Range <br />Nine (9), West of the 6th P.M., Hall County, Nebraska, said Ten (10.0) foot wide <br />easement being more particularly described as follows: <br /> <br />First to ascertain the point of beginning, start at the southeast corner <br />of said South Half of the Southwest Quarter (S l/2SWl/4); thence <br />running westerly, along and upon the south line of said South Half of <br />the Southwest Quarter (S l/2SWI/4), a distance of Seven Hundred <br />Seven and Eight Hundredths (707.08) feet to the ACTUAL point of <br />beginning; thence continuing westerly, along and upon the previously <br />described course, a distance ofTen (10.0) feet; thence deflecting right <br />88053'04" and running northerly, a distance ofFi ve Hundred Seventy- <br />seven and Fifty- five Hundredths (577.55) feet; thence deflecting right <br />91010'27" and running easterly, a distance ofTen (10.0) feet; thence <br />deflecting right 88049'33" and running southerly, a distance of Five <br />Hundred Seventy-seven and Fifty-four Hundredths (577.54) feet to <br />the ACTUAL point of beginning. <br /> <br />That in pursuance of the said agreement and consideration ofTen Dollars ($10.00) paid by <br />the Grantee to the Grantors, the receipt of which is hereby acknowledged, the Grantors hereby grant <br />to the Grantee, its successors and assigns. full and free right and liberty for it, its tenants, servants, <br />visitors and licensees, in common with all other having a like right, at all times hereafter, with or <br />without vehicles of any description, for all purposes connected with the use and enjoyment of the <br />said land of the Grantee, to pass and repass along the said private road for the purpose of ingress and <br />egress to the real estate owned by Grantee, hereinabove described, Grantee shall, as a consideration <br />of this easement, maintain the road over the land. <br /> <br />Page I of 2 <br />
