N :,?,: co c.n 0 (j') EASEMENT AGREEMENT ./? _s-~ So THIS EASEMENT AGREEMENT is made and entered into this 2'-#i' day of December, 2007, by and between WILLIAM ROBERT FAGAN, A/K/A ROBERT FAGAN, AND DARLENE FAGAN, husband and wife ("Fagan") and PFI, L.L.C., a Nebraska limited liability company ("PFI") . WITNESSETH: WHEREAS, Fagan is the owner of the real estate legally described as set forth on attached Exhibit A ("Fagan's Property"); and WHEREAS, PFI is the owner of adjacent real estate legally described as set forth on attached Exhibit B ("PFI's Property"); and WHEREAS, Fagan desires to obtain and PFI is willing to grant an easement to Fagan pursuant to the terms and conditions set forth herein. NOW, THEREFORE, in consideration of the mutual covenants and agreements of the parties, it is agreed as follows: 1. PFI hereby grants and conveys unto Fagan, and their heirs, successors and assigns, an easement to repair fences and to drive livestock to Fagan's Property over, through and upon that portion of PFI's Property legally described as set forth on attached Exhibit C ("the Servient Estate"). 2. It is the intention of the parties that the easement herein described shall be perpetual and constitutes a covenant which shall run with the land for the benefit of Fagan's Property, herein being the "Dominant Estate".
