In consideration of the acceptance of the plat of said DEADWOOD SECOND SUBDIVISION, the Subdivider hereby consents and agrees with the City of Grand Island, Nebraska, that it will install or provide at its expense the following improvements: 1. Paving. Thc Subdivider agrees to waive the right to object to the creation of any paving or repaving district for Johnstown Road where it abuts the subdivision. 2. Water. Public water supply is available to the subdivision, and all new structures requiring service shall be connected to such water supply. 3. Sanitary Sewer. Public sanitary sewer main is not available to the subdivision; therefore individual systems shall be permissible on an initial basis. However, the Subdivider waives the right to protest the creation of a sanitary sewer district within or abutting the subdivision. A fifty foot by forty foot (50' x 40') sanitary sewer easement one hundred thirty feet (130') east of the west property line and five feet (5') north ofthe south property line of Lot 1 is dedicated with this plat for the purpose of providing space for a septic file and reserve septic field for any structure built upon the lot. A fifty foot by forty foot (50'x 40') sanitary sewer easement thirteen feet (13') west of the east property line and eighty feet (80') north ofthe south property line of Lot 2 is dedicated with this plat for the purpose of providing space for a septic file and reserve septic field for any structure built upon the lot. The owners may request and the City Council may vacate these easements in the event that sewer is provided to the property and all structures are connected to sewer utilities. - 2 -
