<br />KNOW ALL MEN BY THESE PRESENTS that GREGORY L. GALLES, is the /tJ I ;::J
<br />Successor Trustee under a Deed of Trust made and entered into on or about June 20,2006, by and
<br />between KELLEY H. MCPHILLIPS, a single person, Trustor, and U.S. BANK TRUST
<br />COMPANY, NATIONAL ASSOCIATION, Trustee, TIERONE BANK, Beneficiary, Said Deed
<br />of Trust was recorded on June 20, 2006 as Instrument No. 2006-05539 ofthe Mortgage Records of
<br />Hall County, Nebraska. Said Deed of Trust having been assigned by virtue of an Assignment dated
<br />July 13,2006 to U.S. BANK, N.A., and which was filed for record on July 20,2006 as Instrument
<br />No. 2006-06445 of the Mortgage Records of Hall County, Nebraska. GREGORY L. GALLES was
<br />appointed Successor Trustee by virtue of a Substitution of Trustee dated August 24, 2007, and
<br />recorded August 28,2007, as Instrument No. 2007-07385 in the Office of the Register of Deeds for
<br />Hall County, Nebraska. GREGORY L. GALLES, Grantor, in consideration of the sum of One
<br />Hundred Eight Thousand One Hundred Sixty-One and 86/100 ($108,161.86) and other good and
<br />valuable consideration received from u.S. BANK, N.A., does hereby grant, bargain, sell, convey and
<br />confinn unto u.S. BANK, N.A., (hereinafter "Grantee" where appropriate), the following-described
<br />real property in Hall County, Nebraska, to wit:

<br />Lot Eight (8), in Block Fifteen (15) in Fairview Park Addition to the City
<br />of Grand Island, Hall County, Nebraska,
<br />
<br />to have and to hold the above-described premises together with all tenements, hereditaments and
<br />appurtenances thereunto belonging unto the Grantee and to Grantee's successors and assigns forever.
<br />Grantor does hereby covenant with Grantee and Grantee's successors and assigns:
<br />
<br />1. That KELLEY H. MCPHILLIPS, as Trustor, failed to pay to Beneficiary payments which
<br />were contractually due, and the Grantor, at the request ofthe Beneficiary, elected to declare
<br />the entire unpaid principal balance, together with interest thereon at once immediately due
<br />and payable.
<br />
<br />2. That a Notice of Default as required by ~ 76-1006 was tiled by Grantor on August 28,2007,
<br />as Instrument No. 2007-07386 of the Miscellaneous Records in the office of the Register of
<br />Deeds of Hall County, Nebraska. A copy of said Notice of Default was thereafter mailed to
<br />all parties entitled to notice, pursuant to said Deed of Trust and in compliance with ~ 76-
<br />1008, R.R.S. Nebraska.

<br />3. That the Trustor failed to cure the default referenced in the Notice of Default within 30 days
<br />after filing of the Notice of Default.
<br />
<br />4. That a Notice of Trustee's Sale was filed by Grantor on October 9, 2007, as Instrument No.
<br />2007-08654 of the Miscellaneous Records in the office of the Register of Deeds of Hall
<br />County, Nebraska. A copy of said Notice of the time and place of the sale was thereafter
<br />mailed to all parties entitled to notice pursuant to said Deed of Trust and in compliance with
<br />~ 76-1008, R.R.S. Nebraska.

<br />5. That Grantor as required by ~ 76-1007 published a Notice of Trustee's Sale to be held on
<br />November 29,2007, at 10:00 a.m.inJ);J.~JQWer..1ob.b--y oftlJeJ-IalLCmmty-Courthouse, 111
<br />West First Streer,'Urand-Is1an:a; Nebraska. Said Notice was published in The Grand Island
<br />Independent, a legal newspaper of Grand Island, Hall County, Nebraska, once a week tor five
<br />consecutive weeks commencing on October 6,2007, and ending November 3,2007. The last
<br />publication notice was at least ten days prior to the Trustee's Sale held on November 29,
<br />2007, and said sale was not later than 30 days after the last publication of notice. ~,~
