<br />KNOW ALL MEN BY THESE PRESENTS:

<br />of .hI..4L./ ~ County, Nebraska, in consideration of $ - - ,receIpt of which b hereby acknowledged, and the
<br />further payment of a sum to make total payment of $59 .5'9 , and in consideration of the benefits to accrue to the easement
<br />hereinafter described from the installation of facilities to provide underground fiber optic service, the covenants, conditions and
<br />agreements herein contained, does hereby grant and convey unto Nebraska Public Power District, its lessees, successors and assigns,
<br />(hereinafter the District), the permanent right, privilege, and right-of-way easement to enter upon and to survey, construct, operate,
<br />maintain, inspect, repair, remove, alter, relocate and reconstruct its underground fiber optic facilities including all related equipment
<br />over, under, upon and across:
<br />
<br />An easement area being a strip of land over, under, upon and across a portion of a tract of land comprising the
<br />Southeast Quarter of the Northeast Quarter (SEY.NE1i4); part of Lot Two (2), Mainland, together with part of the land
<br />accreted thereto situated in the East Half of the Southeast Quarter (EYo,SEY.), all in Section Two (2); and part of the
<br />land accreted to Lot Two (2), Mainland, situated in the Northeast Quarter of the Northeast Quarter (NE'/.NEV1) of
<br />Section Eleven (11), all in Township Ten (10) North, Range Ten (10) West of the 6th P.M. in Hall County,
<br />Nebraska, more particularly described as follows: Beginning at the northeast comer of said Southeast Quarter of the
<br />Northeast Quarter (SEY.NEY.); thence westerly along the north line of said SEV1NEV1, a distance of One Thousand
<br />Three Hundred Twenty Two and Seven Tenths (1,322.7) feet to the northwest corner of said SE'I.NEY.; thence
<br />southerly along the west line of said SE'I.NE'I., a distance of One Thousand Three Hundred Eighteen and Twenty
<br />Nine Hundredths (1,318.29) feet to the southwest corner of said SEY.NEY.; thence southerly along the west line of
<br />said EY2SEY., a distance of Two Thousand Seven Hundred Twelve and Thirty Three Hundredths (2,712.33) feet to
<br />the left bank of the North Channel of the Platte River; thence deflecting right 128022'55" and running northeasterly
<br />along said left bank, a distance of Five Hundred Two and Seventy Five Hundredths (502.75) feet; thence deflecting
<br />right 24020' 59" and running northeasterly along said left bank, a distance of Two IIundred Twenty Seven and Sixty
<br />Six Hundredths (227.66) feet; thence deflecting left 32005' 17" and running northeasterly along said left bank, a
<br />distance of One Hundred Seventy Five and Fifty Five Hundredths (175.55) feet; thence deflecting left 22056'07" and
<br />running nort}leasterly along said left bank, a distance of Two Hundred Seventy One (27 I .0) feet; thence deflecting
<br />right 30039'23" and running northea,.terly along said left bank, a distance of Three Hundred Seventy Seven and
<br />Eighteen Hundredths (377.18) feet; thence deflecting left 41040'05" and running northeasterly along said left bank, a
<br />distance of Four Hundred Thirty One and Forty Four Hundredths (431.44) feet; thence deflecting right 48012'02"
<br />and running northeasterly along said left bank, a distance of One Hundred Forty Seven and Five Tenths (147.5) feet
<br />to the east line of said Section Two (2); thence northerly along the east line of said Section Two (2), a distance of
<br />One Thousand Two Hundred Thirty Five and Twenty Eight Hundredths (1, 235.28) feet to the southeast corner of
<br />said Northeast Quarter (N E Y.); thence northerly along' die j ~ast line of said Section Two (2), a distance of One
<br />Thousand Three Hundred Twenty and Thirteen Hundr~dths (1,320.13) feet to the place of beginning and containing
<br />105.094 acres more or less together with approximateI'y 2.5" acres' mon; or less of additional accretion land lying
<br />between the existing left bank and the approximate centerline of the North Channel ofthe Platte River.
<br />Said easement area is described as a strip of land 30 feet in width, being 30 feet north of and parallel with the south
<br />line of the East Half of the Southeast Quarter of said Section 2, beginning on the west line of the East Half of the
<br />Southeast Quarter of said Section 2; thence easterly approximately 270 feet to the intersection of the south line of the
<br />East Half ofthe Southeast Quarter of said Section 2 with the centerline of the North Channel of the Platte River.
<br />
<br />The actual location of the underground fiber optic facilities may deviate within said easement area.
<br />
<br />The District shall have the right to ingress and egress across and along the property within the easement area for any purpose in
<br />connection with its survey, construction, operati'm, maintenance, inspection, repair, removal, alteration, relocation and reconstruction
<br />of said underground fiber optic facilities and related equipment.
<br />
<br />The District shall have the right at any time to trim or remove such trees and underbrush as may in any way endanger or interfere with
<br />the safe construction, operation, maintenance, alteration or reconstruction of its underground fiber optic facilities and equipment used
<br />in connection therewith.
