<br />200709536 <br /> <br />1.9 "Unit estate" means a unit, together with an undivided interest in the common elements, as set forth <br />in Section 2.3.4 ofthis Declaration, and the right to exclusive use of the limited common elements reserved for <br />the exclusive use of the unit under Section 2.4 of this Declaration. <br /> <br />ARTICLE II. <br /> <br />DESCRIPTION OF CONDOMINIUM <br /> <br />2.0 Description of the Condominium. The condominium is comprised ofa total of5 units which are <br />numbered 929 South Locust Street, 933 South Locust Street, 935 South Locust Street, 937 South Locust Street, <br />and 939 South Locust Street, as contained on the attached diagram and map. The condominium is located <br />entirely in Hall County, Nebraska, and the legal description ofthe real estate included therein is Lots Five (5), <br />Six (6), Seven (7), and Eight (8), Block Sixteen (16), South Grand Island to the City of Grand Island, Hall <br />County, Nebraska. <br /> <br />2.1 Description of the Unit Boundaries. <br /> <br />2.1.1 The interior walls, floors, and ceilings are the boundaries of a unit. All lathe, furring, wallboard, <br />plasterboard, plaster, drywall, paneling, tiles, wallpaper, paint, finished flooring and any other materials <br />constituting any part of the finished surfaces are a part of the unit. All other portions of the walls, floors or <br />ceilings are a part of the common elements. <br /> <br />2.1.2 Any duct, wire, conduit, bearing wall, bearing column or other fixture which lies partially in and <br />partially outside of the boundaries of a unit, as described in Section 2.1.1 above, and any portion serving only <br />that unit is a limited common element allocated solely to that unit; and any portion serving more than one unit <br />or any portion of the common elements is a part of the common elements. <br /> <br />2.1.3 Subject to the provisions of Paragraph 2.1.2, all spaces, interior partitions and other fixtures and <br />improvements within the boundaries of a unit are a part of the unit. <br /> <br />2.1.4 Shutters, awnings, and all exterior doors and windows designed to serve a single unit are limited <br />common elements allocated exclusively to that unit. <br /> <br />2.2 Description of the Square Footage Content of Each Unit. The square footage content space of each <br />unit and of each area ofthe condominium subject to individual and exclusive control is set forth on the Unit <br />Plans of the building as shown on the diagram and plans attached hereto. <br /> <br />2.3 Description of the Common Elements. The common elements include all of the condominium, <br />except the units, including, without limitation, the following: <br /> <br />2.3.1 The roof, foundations, columns, girders, studding, joist, beams, supports, main walls (excluding <br />only non-bearing interior partitions of units), bearing walls, floors, ceilings, windows, doors outside of units and <br />all other structural parts of the building and any replacements thereto, whether any of the foregoing are within <br />units or without; provided that any lathe, furring, wallboard, plasterboard, plaster, drywall, paneling, paint, <br />wallpaper, carpeting, tiles and other such decorative surface coverings or finishing's of common elements <br />within or on unit boundaries are not common elements but are part of the unit. <br /> <br />2.3.2 Installation of services serving more than a single unit, such as power, light, gas, water, heating, <br />refrigeration, air conditioning, pipes, conduits, wires (wherever they may be located, whether in partitions or <br /> <br />- 2 - <br />
