<br />Stephen T. Fleharty, Jr., Trustee, being first duly sworn upon his or her oath, deposes and

<br />says:

<br />1. That the Affiant is the successor trustee under the terms and conditions of the Stephen
<br />T. Fleharty Revocable Trust dated October 4, 1996 (hereinafter referred to as the "said Trust").
<br />
<br />2. That the Affiant became the successor trustee upon the inability of Stephen T. Fleharty
<br />to act as the trustee of said Trust and upon signing an Acceptance to Act as Trustee under the
<br />Stephen T. Fleharty Revocable Trust, an copy of which is attached as Exhibit "A".
<br />
<br />3. That the Affiant remains the sole trustee of the said Trust as of this date.
<br />
<br />4. That among the assets of the said Trust is the following described real property that
<br />was conveyed to the trustee of the said Trust on October 4, 1996, by Warranty Deed recorded on
<br />October 7, 1996, of the records of the Hall County Register of Deeds Office as Document No, 96-
<br />107872:
<br />
<br />A tract ofland comprising a part of the West Half (WYZ) of Northwest Quarter
<br />(NWYt) of Section Twenty-eight (28), Township Eleven (11) North, Range Nine
<br />(9) West of the 6th P.M., Hall County, Nebraska, and more particularly
<br />described as follows: Commencing at the Southeast corner of Lot 17, Block" A"
<br />Parkview Subdivision, thence running Southerly on said East line of said WYZ
<br />of the NWYt of said Section 28, a distance of 157.4 feet, thence Westerly and
<br />parallel to the South line of said Lot 17, a distance of 377 feet to the East right-
<br />of-way line of Pioneer Blvd., thence Northerly on the East right-of-way line of
<br />Pioneer Blvd., a distance of 157.4 feet, thence Easterly and parallel to the South
<br />line of said Lot 17, a distance of 377 feet to the point of beginning.
<br />
<br />5. That pursuant to the terms of the said Trust and 930-3881 (2) of the Nebraska Uniform
<br />Trust Act, the trustee of the said Trust has the power, without court authorization, to acquire or sell
<br />property, for cash or on credit, at public or private sale.
<br />
<br />6, That neither the said Trust or the trust instrument creating the said Trust, nor any part
<br />thereof, has been revoked, amended, or terminated, and the above statements constitute a full
<br />disclosure of all provisions' concerning those items.
