Eickhoff, Jr., being first duly sworn on oath, deposes and states as follows: <br /> <br />1. That Affiant is the owner of record with his spouse, Debra Eickhoff, of the <br />following described real property, to wit: <br /> <br />The North Half (N 12) of the Southwest Quarter (SWV.), Section Twelve (12), <br />Township Ten (10) North, Range Twelve (12) West of the Sixth P.M., Hall <br />County, Nebraska, containing 79.64 acres, more or less; except for a tract of <br />land in the Southwest Quarter (SWY4) of Section Twelve (12), Township Ten <br />(10) North, Range Twelve (12) West of the 6th P.M., Hall County, Nebraska, <br />more particularly described as follows: Commencing at the point where the <br />north line of the North Half of the Southwest Quarter (N Y2 SWV.) of Section <br />Twelve (12), Township Ten (10) North, Range Twelve (12) West of the 6'h <br />P.M., intersects the east boundary line of the north and south public road <br />abutting said premises and running in an easterly direction along and upon said <br />north boundary line for a distance of 125 feet, thence at right angles in a <br />southerly direction a distance of 125 feet, thence at right angles and in a <br />westerly direction a distance of 125 feet to the easterly edge of said public <br />road, thence at right angles and in a northerly direction along and upon the cast <br />edge of said public road to the point of beginning, Hall County, Nebraska. <br /> <br />That Affiant and his spouse are the present title holders in fee simple of the above-described <br />real estate as joint tenants and not as tenants in common. <br /> <br />2. That Affiant and his spouse arc now in either actual or constructive possession <br />of said real estate and the whole thereof, and that they and their immediate and remote <br />Grantors have a continuous and unbroken record chain of title to such real estate and the <br />whole thereof for a period 0 f more than twen ty-three (23) years last past. <br /> <br />3. Affiant further states that he is one and the same person as Fred H. Eickhoff, <br />.Ir., indicated as one of the Grantees of the re,ll estate described above in a Quitclaim Deed <br />dated June 28, 1996, and filed on August 28, 2007, as Instrument No. 0200707387 in the <br />Hall County Register of Deed's Office. <br /> <br />4.
