<br />That a Deed of Trust was made and entered into on or about March 1,2006, by and
<br />bctween Benjamin Shafer, as Trustor, and Archer Cooperative Credit Union, Beneficiary, //), jJ
<br />wherein Archer Cooperative Credit Union was named Trustee. The Deed of Trust was
<br />recorded March 29,2006 in the real estate records o[Hall County, Nebraska as Instrument
<br />No. 0200602720; and,
<br />
<br />That a Deed of Trust was made and entered into on or about May 16, 2006, by and
<br />between Benjamin Shafer, as Trustor, and Archer Cooperative Credit Union, Beneficiary,
<br />wherein Archer Cooperative Credit Union was named Trustee. The Deed of Trust was
<br />recorded June 2, 2006, in the real estate records ofI lall County, Nebraska as Instrument No.
<br />0200604944.
<br />
<br />Hereinafter the Trustee, Archer Cooperative Credit Union, will be referred to as
<br />GRANTOR.
<br />
<br />The GRANTOR in consideration of the sum of $291,000.00 and other valuable
<br />consideration received from Archer Cooperative Credit Union, hereinafter GRANTEE, does
<br />hereby grant, bargain, sell, convey and confirm unto GRANTEE the [olio wing described real
<br />property in Hall County, Nehraska:
<br />
<br />Lot One (I), Block Two (2), in Pondcrosa Lake Estates Third Subdivision in the City
<br />of Grand Island, Hall County, Nebraska.
<br />
<br />To have and to hold the above-described premises together with all tenements,
<br />hereditaments and appurtenances thereto belonging unto the GRANTEE, and to the
<br />GRANTEE'S successors and assigns forever.
<br />
<br />GRANTOR docs hereby covenant with the GRANTEE and with the GRANTEE'S
<br />successors and assigns:
<br />
<br />(1) That Benjamin Shafer, as Trustor, failed to pay the Beneficiary payments which
<br />were contractually due, and the GRANTOR, at the request of the Beneficiary, elected to
<br />declare the entire unpaid principal balance, together with interest thereon, at once
<br />immediately due and payable.
<br />
<br />(2) That a Notice of Default was recorded by GRANTOR on July 17, 2007, as
<br />Instrument No. 0200706033, in the real estate records of Hail County, Nebraska. Within ten
<br />(10) days thereafter, a copy of the recorded Notice of Default was mailed by certified mail,
<br />postage prepaid, to all parties entitled to notice, pursuant to said Deed of Trust and in
<br />compliance with Neb. Rev. Stat. ~76-1008 (R. S. SUPP., 2006). That Trustor, Benjamin
<br />Shafer, failed to cure the default referenced in the Notice of Default within thirty (30) days
<br />atter the recording o[the Notice of Default.
<br />
<br />(3) That a Notice of Default was recorded by GRANTOR on July 17, 2007, as
<br />Instrument No. 0200706034, in the real estate records of Hall County, Nebraska. Within ten
<br />(10) days thereafter, a copy ofthe recorded Notice of Default was mailed by certified mail,
<br />postage prepaid, to all parties entitled to notice, pursuant to said Deed of Trust and in
<br />
