<br />NonCE IS HEREBY GIVEN that on the 1:o~ day of October, 2007, Deutsche Bank National
<br />
<br />Trust Company, as Trustee of Ameriquest Mortgage Securities Inc., Asset Backed Pass. Through
<br />Certificates, Series 2004-R3 Under the Pooling & Servicing Agreement dated as of April 1, 2004,
<br />without recourse, as the plaintiff, filed its Complaint in the District Court of Hall County, Nebraska,
<br />against Kendra L. Ponce, James D. Washington, Jr., and Rene Lia Washington, as the defendants, the
<br />object and prayer of such Complaint being to obtain an accounting, to foreclose a deed of trust given
<br />by said Kendra L. Ponce, marital status unknown, and James D. Washington, Jr., marital status
<br />unknown, to Lawyers Title Insurance Corp., as Trustee for the benefit of Ameriquest Mortgage
<br />Company, Beneficiary to foreclose any interest in or lien upon the real estate hereinafter described of
<br />the above-named defendants, to obtain an order for the sale of the real estate hereinafter described for
<br />the satisfaction of the indebtedness secured by such deed of trust, to reform the legal description
<br />contained in the deed of trust, and to obtain other equitable relief; that such deed of trust is dated
<br />January 22,2004, and was recorded on February 9, 2004, as Instrument Number 0200401139 in the
<br />Office of the Register of Deeds of Hall County, Nebraska, and, after reformation, conveyed to such
<br />beneficiary the following described real estate situated in Hall County, Nebraska, to-wit:

<br />The Northerly Fifty One and Three Tenths (51.3) Feet of the Westerly One Hundred
<br />Forty Eight and Five Tenths (148.5) Feet of Lot Five (5), in Vantine's Subdivision, to the
<br />City of Grand Island, Hall County, Nebraska,
<br />
<br />and that such deed of trust was sold, transferred, and assigned to the plaintiff by written assignment recorded
<br />on January 31, 2005, as Instrument Number 0200500845 in the office of the Register of Deeds of Hall
<br />County, Nebraska.
