Lindquist, a member <br />of the Nebraska State Bar Association, Successor Trustee, hereinafter called "Grantor", pursuant to <br />a power of sale contained in that certain Deed of Trust recorded on August 31, 2004 as Instrument <br />No. 0200408676 in the office of the Register of Deeds of Hall County, Nebraska, and <br />CitiMortgage, Inc., successor by merger with CitiFinancial Mortgage Company, Inc., hereinafter <br />called "Grantee." <br /> <br />WHEREAS, on July 18, 2007, Grantor, executed a Notice of Default pursuant to which <br />notice was given to Fred D. Whitesides, Jr. and Rhonda L. Whitesides, husband and wife, Trustors, <br />under that certain Deed of Trust recorded on August 31, 2004 as Instrument No. 0200408676 in the <br />office oft,1.e Register of Deeds of Hall County, Nebraska, covering that certain premises described <br />as: <br /> <br />The Easterly Thirty-six (36) feet of the Westerly Seventy-four and One Fourth <br />(74 1/4) feet of the North One Half (N1/2) of Lot Nine (9) of the County <br />Subdivision of the South Half of the Southeast Quarter (S 1/2 SE1/4) of Section <br />Sixteen (16), Township Eleven (11) North, Range Nine (9) West of the 6th P.M., <br />Hall County, Nebraska, <br /> <br />that a breach of an obligation for which the trust property was conveyed had occurred, and setting <br />forth the nature of such breach and of his election to sell or cause to be sold such property to satisfy <br />the obligation. Said Notice of Default was filed for record in the Office of the Register of Deeds of <br />Hall County, Nebraska, on July 23,2007, as Instrument No. 0200706182. <br /> <br />A copy of such Notice of Default was thereafter mailed to all parties entitled to notice <br />pursuant to said Deed of Trust and in compliance with Section 76-1008 RRS. Nebraska. <br /> <br />Subsequent thereto, beginning on August 29, 2007, Grantor caused to be published in The <br />Grand Island Independent, a newspaper having a general circulation in Hall County, Nebraska, a <br />Notice of Trustee's Sale setting forth a description of the property to be sold and stating that the <br />described property would be sold at public auction to the highest bidder for cash or certified or <br />cashier's check, at the lower level lobby of the Hall County Courthouse, 1 st & Locust Street, Grand <br />Island, Hall County, Nebraska at 2:00 p.m. on October 10, 2007. Publication of such notice was <br />made for five consecutive weeks on August 29, 2007, September 5, 2007, September 12, 2007, <br />September 19,2007 and September 26,2007, the last publication being at least ten (10) days but not <br />more than thirty (30) days prior to the date of sale. <br /> <br />A copy of such notice of the time and place of sale was thereafter mailed to all parties <br />entitled to notice pursuant to said Deed of Trust and in compliance with Section 76-1008 <br />RRS. Nebraska. <br /> <br />Pursuant to said Notice of Trustee's Sale, John B.
