<br />200708774 <br /> <br />conditions and/or restrictions or planned unit development, map, plat or re- subdivision is recorded against all or any <br />portion of the Property in violation of this Section 8, the instrument(s) recorded shall be null and void. <br /> <br />Section 8. Violations Constitute a Nuisance. Any violation of any provision, covenant, condition, restriction <br />or equitable servitude contained in this Declaration whether by act or omission, is hereby declared to be a nuisance and <br />may be enjoined or abated, whether or not the relief sought is for negative or affmnative action, by any person entitled <br />to enforce the provisions of this Declaration. <br /> <br />Section 9. Violations of Law. Any violation of any federal, state, municipal or local law, ordinance, rule or <br />regulation, pertaining to the ownership, occupation or use of any portion of the Property, is hereby declared to be a <br />violation of this Declaration and shall be subject to any and all of the enforcement procedures set forth in this <br />Declaration. <br /> <br />Section 10. Conflicts in Documents. In case of any conflict between this Declaration and the Articles of <br />Incorporation or the Bylaws of the Association, this Declaration shall control. If there is a conflict between the <br />Articles ofIncorporation and the Bylaws of the Association, the Articles ofIncorporation shall control. <br /> <br />Section 11. Notices. Any submissions or notices required or permitted to be given to the Association or the <br />ACC under or pursuant to this Declaration shall be in writing and shall be given or made by United States registered <br />or certified mail, return receipt requested, with postage prepaid, addressed to the Association at 1233 North Webb Road, <br />Grand Island, Nebraska 68803. Any submission or notice given in any other manner (including, without limitation, any <br />submission or notice given to persons at Declarant's sales office) shall have no force or effect, and shall not be <br />deemed to have been "given" or "received" for any purpose under this Declaration.
