CONDmONSAND <br />RESTRICTIONS OF COPPER CREEK ESTATES SUBDMSION <br /> <br />THIS DECLARATION OF COVENANTS, CONDITIONS AND RElTRICTIONS OF COPPER CREEK <br />ESTATES SUBDIVISION ("Declaration") is made and executed this 12-"'f t1ay of ()C1-f~BcL , 20~, by <br />COPPER CREEK ESTATES - GRAND ISLAND, L.L.c. ("CCE"), a Nebraska Limited Liability Company, as <br />"Declarant" . <br /> <br />RECITALS <br /> <br />A. COPPER CREEK ESTATES - GRAND ISLAND, L.L.C. ("CCE") is the owner of real property described <br />as Lots One (I) through Ninety~Seven (97), inclusive, together with Outlots A, B and C in Copper Creek Estates <br />Subdivision, an Addition to the City of Grand Island, Hall County, Nebraska. <br /> <br />NOW THEREFORE, Declarant hereby declares that the property described above shall be held, sold and <br />conveyed subject to the following covenants, conditions, restrictions, easements, rights of way, obligations, liabilities, <br />charges and other provisions set forth herein, which are for the purpose of protecting the value and desirability of, and <br />which shall run with, the above-described property, and shall be binding on all parties having any right, title, or <br />interest in the above-described property or any part thereat and on their personal representatives, heirs, successors and <br />assigns, and shall inure to the benefit of each owner thereof. <br /> <br />ARTICLE I <br /> <br />DEFINTTIONS <br /> <br />Section L "Association" shall mean and refer to COPPER CREEK ESTATES SUBDIVISION <br />HOMEOWNERS ASSOCIATION, INC., a Nebraska Non~Profit Corporation, and its successors and assigns. "Board of <br />Directors" or "Board" shall mean and refer to the duly elected and qualified members of the Board of Directors of the <br />Association acting in an official capacity. <br />
