<br />THIS DEED OF TRUST ("Security Instrument") is made on September 20, 2007. The grantor is MARY J ROSS,

<br />Nebraska 68501 . ("Trustee"). The beneficiary is TierOne Bank, which is organized and existing under the laws
<br />of the United States of America and whose address is 1235 'N' St / PO Box 83009, Lincoln, Nebraska 68501
<br />("Lender"). MARY J ROSS and JEFFREY L ROSS owe Lender the principal sum of Twenty-eight
<br />Thousand Nine Hundred Fifteen and 50/100 Dollars (U.S. $28,915.50), which is evidenced by the note,
<br />consumer loan agreement, or similar writing dated the same date as this Security Instrument (the "Note"), which
<br />provides for monthly payments ("Periodic Payments"), with the full debt, ifnot paid earlier, due and payable on
<br />March 18, 2008. This Security Instrument secures to Lender: (a) the repayment of the debt evidenced by the Note,
<br />with interest, and all renewals, extensions and modifications of the Note; (b) the payment of all other sums, with
<br />interest, advanced to protect the security of this Security Instrument under the provisions of the section titled
<br />Protection of Lender's Rights in the Property; and ( c) the performance of Borrower's covenants and agreements

<br />BORROWER COVENANTS that Borrower is lawfully seised of the estate hereby conveyed and has the right to
<br />grant and convey the Property and that the Property is unencumbered, except for encumbrances of record.
