So <br /> <br />The undersigned, as Trustor (Borrower) in a certain Trust Deed to be executed hereafter in which Wesley D. Nespor, attorney, is Trustee <br />and The City of Grand Island, Nebraska is Beneficiary, which Trust Deed is to secure payment of (x ) a loan or ( ) purchase money due Beneficiary, <br />and in consideration of such extension oferedit, each of the undersigned Trustor(s) acknowledge: <br />1. I understand that as Trustor I may have a right to claim this property as homestead. I hereby waive and disclaim any and all <br />rights available to retain any homestead rights in the property described in the Deed of Trust to be executed hereafter in the event of default in <br />payment of sums secured by the Deed of Trust. This waiver and disclaimer includes waiver of any right to at some time in the future designate a <br />homestead interest in any of the real estate described in the Deed of Trust. <br />This waiver is my voluntary act and deed, and is intended as a written, knowing and voluntary waiver of all homestead rights and a <br />disclaimer of any right to defer selection or designation of homestead rights as allowed by the Nebraska Farm Homestead Protection Act. <br />2. I aftinnatively state that: <br />(x) A. Disclaimer of right to make a designation of homestead. No part of my homestead is presently or in the future will be situated upon the <br />real estate described in the Trust Deed that I am about to sign. I understand that if I establish a homestead on any part of the real estate <br />during the time the Trust Deed remains unsatisficd and a lien upon the real estate, there shall be no right to make a designation of <br />homestead in the event of a foreclosure or trustee's sale upon the Trust Deed. <br />(x) B. Waiver ofright to make a designation of homestead. I understand that I have a right to make a designation of homestead in the Trust Deed <br />and the execution of this Acknowledgment constitutes a waiver of any and all rights otherwise available for the purpose of aft(Jrding me <br />the opportunity to retain my homestead in the event of a default upon this Trust Deed. <br />3. I further acknowledge that I have read the foregoing and have signed this document prior to the execution of any Trust Deed.
