Submissions <br />Modification of Restrictions. The Grantee shall submit any requests to use the Property <br />for residential purposes, install monitoring wells or other modification to the above restrictions to <br />Grantor, with a copy to EPA and Nebraska DEQ, by first class mail, postage prepaid, addressed <br />as follows: <br />(a) to Grantor: Corps of Engineers, Omaha District <br />ATTN: CENWO -RE <br />106 South 15th Street <br />Omaha, NE 68102 -1618 <br />(b) to EPA: U.S. Environmental Protection Agency <br />Region VII <br />901 North 5th Street <br />Kansas City, KS 66101 <br />(c) to State: Nebraska Department of Environmental Quality <br />P.O. Notice of Underground Storage Tanks /Aboveground Storage Tanks <br />The Grantee is hereby informed and does acknowledge that Underground Storage Tanks <br />and Aboveground. Storage Tanks that contained gasoline, diesel fuel and heating oil, were <br />formerly located on the premises. All underground storage tanks and surrounding soil were <br />removed no later than 1993. The aboveground storage tanks were removed in 2002. <br />i. Notice of the Potential Presence of Munitions and Explosives of Concern (MEC) <br />1. The Grantee is hereby notified that due to the former use of the Property as a <br />military installation, the Property may contain munitions and explosives of concern (MEC). The <br />term MEC means specific categories of military munitions that may pose unique explosives <br />safety risks and includes: (1) Unexploded Ordnance (UXO), as defined in 10 U.S.C. § 101(e)(5); <br />(ii) Discarded military munitions (DMM), as defined in 10 U.S.C. § 2710(e)(2); or (iii) <br />Munitions constituents (e.g., TNT, RDX), as defined in 10 U.S.C. § 2710(e)(3), present in high <br />enough concentrations to pose an explosive hazard. <br />2. The Property (specifically Load Line 1) was previously used as a load, assemble <br />and pack (LAP) facility for the production of artillery shells, mines, bombs, and rockets.
