Wolf, a <br />member of the Nebraska State Bar Association and Successor <br />Trustee, upon a Deed of Trust made and entered into on or about <br />July 28, 2005, by and between Warren G. Lemburg and Janet M. <br />Lemburg, husband and wife, Trustors, and Woitaszewski Brothers <br />Land Partnership, Beneficiaries and Denise D. Myers, Trustee, <br />which Deed of Trust was filed on August 1, 2005, in the Register <br />of Deeds office of Hall County, Nebraska, as Document No. <br />0200507429, herein called the Grantor, in consideration of <br />Ninety Thousand and no/100 Dollars ($90,000.00), received from <br />Grantee, does hereby grant, bargain, sell, convey and confirm <br />unto Woitaszewski Brothers Land Partnership, herein called the <br />Grantee, the following described real property in Hall County, <br />Nebraska: <br /> <br />Lot One(l), Ski Enterprise Subdivision, Hall County, <br />Nebraska. <br /> <br />TO HAVE AND TO HOLD the above described premises together <br />with all tenements, hereditaments, and appurtenances thereto <br />belonging and to the Grantee. <br /> <br />Grantor does hereby covenant with Grantee as follows: <br /> <br />1. That Warren G. Lemburg and Janet M. Lemburg, Trustors, <br />failed to pay the Beneficiary payments which were contractually <br />due and the Grantors, at the request of the Beneficiary, elected <br />to declare the entire unpaid principal balance together with <br />interest thereon at once immediately due and payable; <br /> <br />2. That a notice of default was filed by Grantor on June <br />5, 2007, in the Register of Deeds office of Hall County, <br />Nebraska, as Document No. 0200704636. A copy of the notice of <br />default was served upon Warren G. Lemburg and Janet M. Lemburg, <br />Trustors, by certified mail, postage prepaid June 7, 2007; <br />
