<br />of ~ County, Nebraska, in consideration of $ - , receipt of which is hereby acknowledged, and the further
<br />payment of a sum to make total payment of $ 5c::l? o.!do(es) hereby grant and convey unto Nebraska Public Power District
<br />(hereinafter called District), its lessees, successors, and assigns, the perpetual right, privilege, and easement of right-of-way
<br />to survey, construct, operate, maintain, inspect, repair, remove, alter, relocate and reconstruct an electric transmission line,
<br />including all necessary structures, electric wires, communication cables and wires, guys, and any other equipment used in
<br />connection therewith, (hereinafter collectively called the electric transmission line), along a route described herein. The
<br />centerline of the electric transmission line shall be established by the actual location of the electric transmission line as
<br />originally constructed on said premises. The location of the easement area is described as follows:

<br />An easement area being a strip of land for an electric transmission line, over, under, upon and across a
<br />portion of the Southwest Quarter of the Southeast Quarter of Section 6, Township 9 North, Range 12 West of
<br />the 6th P.M., Hall County, Nebraska EXCEPT a tract described in Deed Book 134, Page 313 and a tract of
<br />land described in Instrument No. 99-105155 in the Office of the Register of Deeds for Hall County, Nebraska,
<br />said strip of land is 10 feet in width, being parallel with and 10 feet north of a reference line, (the reference
<br />line is the south sideline of said strip of land and coincident with a portion of the north right-of-way line of a
<br />county road along the south line of said Southwest Quarter of the Southeast Quarter), said reference line is
<br />described as follows: Beginning on the west line at a location 33 feet north of the Southwest Corner of said
<br />Southwest Quarter of the Southeast Quarter; thence east parallel with and 33 feet north of the south line of
<br />said Southwest Quarter of the Southeast Quarter, 614.89 feet, more or less to the west line of Rima
<br />Subdivision, Hall County Nebraska, and the point of termination of said reference line. The left sideline of said
<br />strip of land is lengthened or shortened to begin on the west line of said Southwest Quarter of the Southeast
<br />Quarter and to end on the west line of Rima Subdivision. Said strip of land contains 6149 square feet, (0.14)
<br />acres, more or less. The approximate centerline location of the electric transmission line will be 35 feet north
<br />of the south line of said Southwest Quarter, and 2 feet north of the north right-of-way line of the county road
<br />along the south line of said Southwest Quarter of the Southeast Quarter.

<br />AND:

<br />An easement area being a strip of land 10 feet in width, being parallel with and 10 feet north of a reference
<br />line, (the reference line is the south sideline of said strip of land and coincident with a portion of the north
<br />right-of-way line of a county road along the south line of said Southwest Quarter of the Southeast Quarter),
<br />said reference line is described as follows: Beginning on the east line of Rima Subdivision, Hall County
<br />Nebraska at a location 33 feet north of the Southeast Corner of said subdivision; thence east parallel with and
<br />33 feet north of the south line of said Southwest Quarter of the Southeast Quarter, 465 feet, more or less to
<br />the east line of said Southwest Quarter of the Southeast Quarter and the point of termination of said
<br />reference line. The left sideline of said strip of land is lengthened or shortened to begin on the east line of
<br />Rima Subdivision and to end on the east line of said Southwest Quarter of the Southeast Quarter. Said strip
<br />of land contains 4650 square feet, (0.11) acres, more or less. The approximate centerline location of the
<br />electric transmission line will be 35 feet north of the south line of said Southwest Quarter, and 2 feet north of
<br />the north right-of-way line of the county road along the south line of said Southwest Quarter of the Southeast
<br />Quarter. .

<br />The District shall have the right of ingress and egress across and along the property within the easement area for any purpose
<br />in connection with the survey, construction, operation, maintenance, inspection, repair, removal, alteration, relocation and
<br />reconstruction of the District's electric transmission line.
<br />
<br />The District shall also have the right at any time to trim or remove such trees and underbrush within the easement area as
<br />may in any way endanger or interfere with the safe construction, operation, maintenance, repair, removal, alteration, relocation
<br />or reconstruction of the District's electric transmission line, including but not limited to, topping or removing any other trees
<br />which in falling would come within fifteen (15) feet of the nearest electric line conductor. All refuse from such tree cutting or
<br />trimming shall be burned or removed by the District, and the District shall have the right to control by chemicals all trees and
<br />brush within the described easement area if said easement area is not being utilized for cultivated crops.
<br />
<br />The District agrees to pay the Grantor or Lessee, as their interests may appear, for any damage to personal property, fences,
<br />livestock, and to growing crops caused by the survey and original construction of the District's electric transmission line. The
<br />District agrees to take all reasonable steps to restore, as nearly as possible to the condition it was in prior to construction, any
<br />land which is damaged as a result of said construction. Final payment shall be made on or before 60 days after completion of
<br />the construction stated herein.
