<br />TRUSTEE'S DEED
<br />
<br />This instrument, made this 20th day of February, 2007, between Eric H. Lindquist, a
<br />member of the Nebraska State Bar Association, Successor Trustee, hereinafter called "Grantor",
<br />pursuant to a power of sale contained in that certain Deed of Trust recorded on September 29,2000
<br />as Instrument No. 0200008139 in the office of the Register of Deeds of Hall County, Nebraska, and
<br />the Secretary of the Department of Housing and Urban Development, hereinafter called
<br />"Grantee."
<br />
<br />WHEREAS, on December 5, 2006, Grantor, executed a Notice of Default pursuant to which
<br />notice was given to Stella E. Smith and LaVeta K. Journey, each a single person, Trustors, under
<br />that certain Deed of Trust recorded on September 29, 2000 as Instrument No. 0200008139 in the
<br />office of the Register of Deeds of Hall County, Nebraska, covering that certain premises described
<br />as:
<br />
<br />THE SOUTHERL Y TWENTY (20) FEET OF LOT ONE HUNDRED
<br />TWENTY FOUR (124) AND THE NORTH THIRTY (30) FEET OF LOT
<br />ONE HUNDRED TWENTY FIVE (125), OF HAWTHORNE PLACE TO
<br />THE CITY OF GRAND ISLAND, HALL COUNTY, NEBRASKA,
<br />
<br />that a breach of an obligation for which the trust property was conveyed had occurred, and setting
<br />forth the nature of such breach and of his election to sell or cause to be sold such property to satisfY
<br />the obligation. Said Notice of Default was filed for record in the Office of the Register of Deeds of
<br />Hall County, Nebraska, on December 7, 2006, as Instrument No. 0200610851.
<br />
<br />A copy of such Notice of Default was thereafter mailed to all parties entitled to notice
<br />pursuant to said Deed of Trust and in compliance with Section 76-1008 RRS. Nebraska.
<br />
<br />Subsequent thereto, beginning on January 9, 2007, Grantor caused to be published in The
<br />Grand Island Independent, a newspaper having a general circulation in Hall County, Nebraska, a
<br />Notice of Trustee's Sale setting forth a description of the property to be sold and stating that the
<br />described property would be sold at public auction to the highest bidder for cash or certified or
<br />cashier's check, at the lower level lobby of the Hall County Courthouse, 1 st & Locust Street, Grand
<br />Island, Hall County, Nebraska at 2:00 p.m. on February 20, 2007. Publication of such notice was
<br />made for five consecutive weeks on January 9, 2007, January 16,2007, January 23, 2007, January
<br />30,2007 and February 6, 2007, the last publication being at least ten (10) days but not more than
<br />thirty (30) days prior to the date of sale.
<br />
<br />A copy of such notice of the time and place of sale was thereafter mailed to all parties
<br />entitled to notice pursuant to said Deed of Trust and in compliance with Section 76-1008
<br />RRS. Nebraska.
<br />
<br />Pursuant to said Notice of Trustee's Sale, John B. McDermott, attorney for Grantor, did at
<br />the time and place mentioned in said Notice of Trustee's Sale, offer said property for sale at public
<br />auction, and did sell the same to Wells Fargo Bank, N.A., successor by merger to Wells Fargo
<br />Home Mortgage, Inc. for the sum of $56,984.29, it being the highest bidder therefor. Wells Fargo
<br />Bank, N.A., successor by merger to Wells Fargo Home Mortgage, Inc. has assigned all of its right,
<br />title and interest in such bid to Grantee.
