<br />200707231 <br /> <br />in accordance with plans and specifications approved by the Director of Public Works, and subject <br /> <br /> <br />to the City's inspection. A connection fee of Twenty Two Thousand Nine Hundred Ninety Four <br /> <br /> <br />Dollars and Fifty One Cents ($22,994.51) is due upon the execution ofthis agreement. the remainder <br /> <br />ofthe connection fee will be paid using the same pro-rata formula as additional parcels receive final <br /> <br />subdivision approval. <br /> <br />5. Storm Drainage. The Subdivider agrees to grade all lots in the subdivision in <br /> <br />conjunction with the development proposed thereon so that storm drainage is conveyed to a public <br /> <br />right-of-way or to other drainage systems approved by the Director of Public Works. <br /> <br />6. Sidewalks. The Subdivider shall install and maintain all public sidewalks <br /> <br />required by the City of Grand Island when the lots are built upon, and such sidewalk shall be <br /> <br />regulated and required with the building permit for each such lot. Sidewalks shall not be required on <br /> <br /> <br />the State Street Side of Lots Four (4) and Five (5) of Block Nine (9) due to the ditch between the <br /> <br /> <br />back of these lots and State Street and the existence of a City maintained Hike/Bike Trail. <br /> <br /> <br />7. Setbacks. The front yard setback of Lots Seven (7) and Eight (8) Block Nine <br /> <br /> <br />(9) shall be on the Imperial Place side of the lots. The rear yard setback of Lots Seven (7) and Eight <br /> <br /> <br />(8) Block Nine (9) shall be on the Ebony Lane side of the lots. The Majestic A venue/Ebony Lane <br /> <br />side of Lot Eight (8) Block Eight (8) shall be considered a street side yard for setback purposes. <br /> <br />8. Easements. Any easements shall be kept free of obstructions and the <br /> <br />Subdivider shall indemnify the City for any removal or repair costs caused by any obstructions. <br /> <br />9. Engineering Data. All final engineering plans and specifications for public <br /> <br />improvements shall bear the signature and seal of a professional engineer registered in the State of <br /> <br />Nebraska and shall be furnished by the Subdivider to the Department of Public Works for approval <br /> <br />- 4 - <br />
