REV. STAT. 930-24,129 (Cum. Supp. 2006): <br />1. The value of the interest held by Albert H. Werner, Deceased as a tenant in common <br />of an undivided oneMfifth (1/5) interest in the following described real estate does not exceed the <br />sum of Twenty-Five Thousand and Noll 00 Dollars ($25,000.00) as the current assessed <br />valuation of said real estate as shown on the assessment rolls in the Office of the Hall County <br />Assessor for the year 2002, the date of the decedent's death, was Eighty-Eight Thousand Three <br />Hundred Ninety-Nine and No/IOO Dollars ($88,399.00), one-fifth of which is Seventeen <br />Thousand Six Hundred Seventy-Nine and 80/100 Dollars ($17,679.80): <br /> <br />Lot Six (6), Block Eight-Seven (87), Original Town of Grand Island, Hall <br />County, Nebraska <br /> <br />2. Thirty (30) days have elapsed since the death of the Decedent as shown by the <br />certified copy of the decedent's death certificate attached hereto as Exhibit "A" and incorporated <br />herein by this reference. <br />3. No application or petition for the appointment of a personal representative is pending <br />or has been granted in any jurisdiction. <br />4. Affiant, as the surviving spouse of Albert H. Werner, Deceased, is entitled to the real <br />property described hereinabove at Paragraph 1 by virtue ofthe provisions of the Last Will and <br />Testament of Albert H.
