<br />CORRECTED <br />6I>ULfYI~.rti:il. .2 /) 0 '7 () V'I 'I !; <br /> <br />200706148 <br /> <br />200704443 <br /> <br />AMENDED <br />ORDINANCE NO. 4'17 <br /> <br />AN ORDINANCE LEVYING A SPECIAL ASSESSMENT UPON THE LOTS~ <br />PARTS OF LOTS, LAND AND REAL EST ATE, ABUTTING UPON AND ADJACENT TO <br />AND ESPECIALLY BENEFITTED BY THE IMPROVEMENTS IN PAVING DISTRICT <br />NO. 2005-3, SANITARY SEWER IMPROVEMENT DISTRICT NO. 2005-1, AND WATER <br />IMPROVEMENT DISTRICT NO. 2005-1 IN THE VILLAGE OF DONIPHAN, HALL <br />COUNTY, NEBRASKA, TO DEFRAY THE COST OF SAID IMPROVEMENTS, TO THE <br />EXTENT O~' THE SPECIAL BENEFIT TO SUCH LOTS, PARTS OF LOTS, LAND AND <br />REAL EST ATE BY RECENT OF SUCH IMPROVEMENTS. <br /> <br />WHEREAS, it has been determined by the Village Board, sitting as a board of equalization, <br />after publication and notice to property owners as required by law, that the benefits to the lots, parts <br />oflots, land and real estate in paving District No. 2005-3, Sanitary Sewer Improvement District No. <br />2005-1, and \Var.er Improvement District No. 2005-1 of the Village of Doniphall, Hall County <br />Nebraska, are equal and uniform in accordance with the benefits derived thereto. <br /> <br />THEREFORE, BE IT ORDAINED BY THE CHAIRMAN AND BOARD OF <br />TRUSTEES FOR THE VILLAGE OF DONIPHAN, NEBRASKA: <br /> <br />Sec. 1. That there be and hereby is levied and assessed against the lots, parts oflots, land and <br />real estate, in the aforesaid improvement districts abutting upon, adjacent to and especially benefitted <br />by, the improvements of said districts a special tax of $479,807.45 amount to pay the cost of said <br />improvements in said districts, to be portioned among the lots, parts of lots, land and real estate <br />according to the equal improvement each of said lots derived therefrom which the Board of <br />Equalization has considered to be fair and equitable, and duly adopted. All of said assessments <br />being in proportion to the benefits received by the real estate in question. <br /> <br />Sec. 2.
