<br />Block Four (4), In Gilbert's Addition to the City of Grand Island, Hall County, Nebraska

<br />ParcelS: Fractional Lot Eight (8), in Block Nineteen (19) of Palmer's Subdivision of Lot
<br />Seven (7), of the County Subdivision of the Southeast Quarter (SE 1/4) of the Southwest
<br />Quarter (SWI/4) of Section Sixteen (16), in Township eleven (II) North, Range
<br />Nine (9) West of the 6th P.M., Hall County, Nebraska; and its complement:
<br />Fractional Lot Eight (8), in Fractional Block Seven (7) of Spaulding and Gregg's
<br />Addition to the City of Grand Island, Hall County, Nebraska;
<br />
<br />WHEREAS, Borrower and Lender hereby desire to amend the existing Deed of Trust identified
<br />hereinabove to extend its maturity by reason of the execution and delivery of a new Note evidencing the
<br />replacement of the original Note that contained a stated maturity date that the parties now agree should be
<br />extended to allow for a complete amortization of the remaining indebtedness through installment
<br />payments as provided in such replacement Promissory Note;
<br />
<br />NOW, THEREFORE, it is agreed:
<br />
<br />I. Security for New Instrument of Indebtedness. The indebtedness described in the Deed of
<br />Trust identified above, shall from the date hereof secure a Note in the amount of Five Hundred Twenty
<br />Thousand and Noll 00 Dollars ($520,000.00) of even date herewith, together with all renewals,
<br />modifications and extensions thereof and any and all future advances and re-advances thereof.
<br />
<br />2. Modification of Date of Stated Maturitv. The Maturity Date in respect to the indebtedness to
<br />be secured the Deed of Trust hereby modified is extended from February 1, 2007 to July II, 2029.
<br />
<br />3. Continuing Effect. Except as specifically modified by this Deed of Trust Modification
<br />Agreement, all other terms and provisions of the Deed of Trust hereinabove identified shall remain in full
<br />force and effect.
<br />
<br />4. Effect on Other Security. All real estate mortgages, deeds of trust, assignments and security
<br />agreements heretofore or concurrently herewith to be granted shall remain in full force and effect to the
<br />extent not inconsistent with this Deed of Trust Modification Agreement and shall continue as security for
<br />Borrower's remaining indebtedness previously existing and additional indebtedness hereinabove set forth
<br />until such sum shall be paid, as well as any future indebtedness owing from Borrower to the Lender for
<br />future advances and renewals in respect to all sums owing from Borrower to Lender.
<br />
<br />5. Additional Documentation. Borrower further covenants to and with Lender that Borrower
<br />shall, and will, at any time, now or later, upon request, make, do, execute and deliver all such further and
<br />other acts, deeds and things as shall be reasonably required to effectuate the intention of this Deed of
<br />Trust Modification Agreement and to insure and confirm to the Lender all and singular the property,
<br />securities and rights described, and intended to be conveyed, as security so as to render the same, and all
<br />portions, whether now owned or later acquired, subject to these terms, provisions and conditions
<br />according to the true intent and purposes expressed.
<br />
<br />6. Waiver. The failure of the Lender, at any time, to require the performance by the Borrower of
<br />any of these terms, covenants and agreements shall, in no way, affect its rights to enforce the same; nor
<br />the waiver by the Lender of any breach of any term, covenant or agreement be taken or held to be a
<br />waiver of any succeeding breach of any such term, covenant or agreement, or as a waiver of the term,
<br />covenant and Agreement itself.
