<br />TRUSTEE'S DEED UPON SALE
<br />
<br />WILLIAM A. FRANCIS, as Trustee, does hereby grant, transfer and convey, without
<br />covenant or warranty, expressed or implied, to STEPHEN E. FITZGERALD and COLLEEN G.
<br />FITZGERALD, husband and wife, as Joint Tenants, (hereinafter called "Grantee"), the following
<br />described real property:
<br />
<br />The West 36 feet 8 inches (36'8") of Lot Six (6), Block Thirty-f()ur (34), Original
<br />Town, now City of Grand Island, Hall County, Nebraska,
<br />
<br />together with all buildings, improvements, fixtures, accessories and appurtenances thereto
<br />belonging.
<br />
<br />To have and to hold the above-described property unto the Grantee, its successors and
<br />assigns.
<br />
<br />This conveyance is made pursuant to the powers conferred upon the Trustee by a certain
<br />Deed of Trust dated the 3rd day of November, 2004, executed by Scott E. Dominick and Carla M.
<br />Dominick, Husband and Wife, as Trustor(s). The Deed of Trust was recorded on November 3,
<br />2004, as Instrument No. 200410749, of the records in the office of the Hall County Register of
<br />Deeds, to secure the payment of a Promissory Note in the original sum of Seventy Four Thousand
<br />Dollars ($74,000.00) and interest as therein provided.
<br />
<br />Default has occurred under the terms of said Deed of Trust and the obligations secured
<br />thereby, as more particularly set forth in the Notice of Default recorded February 6, 2007, in the
<br />Office of the Hall County Register of Deeds. On Mm'ch 16,2007, a copy of the Notice of Default
<br />together with recording data shown thereon was mailed to the Trustors by certified mail, return
<br />receipt requested.
<br />
<br />After the lapse of not less than one (1) month, on May 23, 2007, Trustee, William A.
<br />Francis, causing Notice of Trustee's Sale to be published as required by law in The Grand Island
<br />Independent, a newspaper having general circulation in Hall County, Nebraska. The publication
<br />was run once a week for five (5) consecutive weeks, with the last publication occurring on June 18,
<br />2007. A copy of the published Notice of Trustee's Sale was mailed to the Trustors as required by
<br />law.
<br />
<br />All applicable statutory provIsIons of the Statutes of the State of Nebraska and all
<br />provisions of the above-described Deed of Trust have been fully complied with as to the acts to be
<br />perfornled and notices to be given.
<br />
<br />The above-described real property was sold at public auction at the time and place of sale to
<br />the Grantee, the highest bidder at said sale, for the sum of Sixty Thousand Eight Hundred Eighty
<br />Dollars ($60,880.00). The sale was conducted on the 28th day of June, 2007, at 11 :00 a.m., the date
<br />,md time set forth in the Notice of Sale.

<br />IN WITNESS WHEREOF, the undersigned Trustee has executed this Trustee's Deed on the
