<br />This instrument, made this 21st day of June, 2007, between Eric H. Lindquist, a member of
<br />the Nebraska State Bar Association, Successor Trustee, hereinafter called "Grantor", pursuant to a
<br />power of sale contained in that certain Deed of Trust recorded on November 23,2004 as Instrument
<br />No. 0200411400 in the office of the Register of Deeds of Hall County, Nebraska, and The Bank of
<br />New York Trust Company, N.A. as successor to IPMorgan Chase Bank N.A. as Trustee,
<br />Residential Funding Company, LLC flk/a Residential Funding Corporation, Attorney in Fact,
<br />hereinafter called "Grantee."
<br />
<br />WHEREAS, on September 22, 2006, Grantor, executed a Notice of Default pursuant to
<br />which notice was given to Randall 1. Yost and Patricia L. Yost, husband and wife, Trustors, under
<br />that certain Deed of Trust recorded on November 23, 2004 as Instrument No. 0200411400 in the
<br />office of the Register of Deeds of Hall County, Nebraska, covering that certain premises described
<br />as:

<br />THE WESTERLY FIFTY FIVE (55) FEET OF THE NORTHERLY NINETY
<br />TWO (92) FEET AND THE SOUTHERLY FIFTY (50) FEET OF THE
<br />WESTERLY THIRTY FIVE (35) FEET OF LOT TWO (2) AND THE
<br />EASTERL Y FIFTEEN (15) FEET OF LOT THREE (3), IN BLOCK SIX (6),
<br />IN THE ORIGINAL TOWN OF DONIPHAN, HALL COUNTY,
<br />NEBRASKA,
<br />
<br />that a breach of an obligation for which the trust property was conveyed had occurred, and setting
<br />forth the nature of such breach and of his election to sell or cause to be sold such property to satisfy
<br />the obligation. Said Notice of Default was filed for record in the Office of the Register of Deeds of
<br />Hall County, Nebraska, on September 25,2006, as Instrument No. 0200608571.
<br />
<br />A copy of such Notice of Default was thereafter mailed to all parties entitled to notice
<br />pursuant to said Deed of Trust and in compliance with Section 76-1008 R.R.S. Nebraska.
<br />
<br />Subsequent thereto, beginning on May 10, 2007, Grantor caused to be published in The
<br />Grand Island Independent, a newspaper having a general circulation in Hall County, Nebraska, a
<br />Notice of Trustee's Sale setting forth a description of the property to be sold and stating that the
<br />described property would be sold at public auction to the highest bidder for cash or certified or
<br />cashier's check, at the lower level lobby of the Hall County Courthouse, 1st & Locust Street, Grand
<br />Island, Hall County, Nebraska at 2:00 p.m. on June 20, 2007. Publication of such notice was made
<br />for five consecutive weeks on May 10,2007, May 17,2007, May 24,2007, May 31, 2007 and June
<br />7,2007, the last publication being at least ten (10) days but not more than thirty (30) days prior to
<br />the date of sale.

<br />A copy of such notice of the time and place of sale was thereafter mailed to all parties
<br />entitled to notice pursuant to said Deed of Trust and in compliance with Section 76-1008
<br />R.R.S. Nebraska.
<br />
<br />Pursuant to said Notice of Trustee's Sale, John B. McDermott, attorney for Grantor, did at
<br />the time and place mentioned in said Notice of Trustee's Sale, offer said property for sale at public
<br />auction, and did sell the same to Grantee for the sum of $74,250.00, it being the highest bidder
<br />therefor.
