<br />(4) Notice of Trustee's Sale was published and a copy of the Notice of Trustee's
<br />Sale was served upon Cooney Properties, Inc.; Deana K. Walocha, Attorney for Adair Asset
<br />Management/US; Roland E. Reynolds and Luella M. Reynolds; by certified mail, return
<br />receipt requested, postage prepaid and first class mail on May 14, 2007.
<br />(5) Grantor published Notice of Trustee's Sale, to be held on June 20, 2007 at
<br />10:00 a.m., in the lower lobby of the Hall County Courthouse, in the City of Grand Island,
<br />County of Hall, State of Nebraska, which Notice of Trustee's Sale was published in The
<br />Grand Island Independent, once a week for five (5) consecutive weeks, commencing on May
<br />11, 2007 and ending on June 8, 2007. The last publication of Notice of Trustee's Sale was
<br />at least ten (10) days prior to the Trustee's Sale, and said sale was not later than thirty (30)
<br />days after the last publication of Notice of Trustee's Sale.
<br />(6) Grantor conducted the sale of the real property at public auction and has
<br />accepted the bid of TierOne Bank, a United States Corporation, in the sum of Fifty -Five
<br />Thousand Eight Hundred and No /100 Dollars ($55,800.00), as the highest bid upon said real
<br />property. Grantor has complied with the requirements of the above - referenced Deed of Trust
<br />and the requirements of Nebraska Revised Statutes, Sections 76 -1001 through 76 -1018,
<br />(Reissue 1990), in the exercise of the sale of the real property described herein at the
<br />Trustee's Sale held on June 20, 2007.
<br />This Deed shall operate to convey to the Grantees, without right of redemption, the
<br />Grantor's title and all right, title, interest and claim of the Trustors, and their successors in
<br />interest and of all persons claiming by, through or under it, in and to the above - described real .
<br />property, including all such right, title, interest and claim in interest subsequent to the
<br />execution of the Deed of Trust.
<br />This Deed is subject to all easements, restrictions or covenants of record, which
<br />Grantor is not entitled to convey pursuant to Nebraska Revised Statutes, Section 76- 1010(2),
<br />(Reissue 1990).
