<br />, " <br />>. - <br /> <br />200705147 <br /> <br />Following the completion of such operation and/or maintenance, the Grantee shall <br /> <br />replace the removed fence with a similar kind and quality in the same location as the <br /> <br />existing fence and remove the temporary fencing. <br /> <br />Grantee further agrees that following the completion of operation and <br /> <br />maintenance activities of the public utilities, the City's crews and or contractors shall <br /> <br />leave the ground west of the existing fence line as reasonably practical in the same <br /> <br />condition and grade as it existed prior to such activities. Any such public utilities and <br /> <br />appurtenances placed in, upon, above, along, over, across, underneath, or through the <br /> <br />utility easement and right of way shall remain the property of Grantee, and may be <br /> <br />removed or replaced at any time. <br /> <br />Grantor shall have the right to use the easement and right-of-way for purposes, <br /> <br />including planting, cultivation, and related activities associated with the growing and <br /> <br />harvesting of crops; provided that Grantor shall not erect, construct, or place permanent <br /> <br />structures of buildings; or store or accumulate combustible materials in, upon, above, <br /> <br />along, over, across, underneath, or through the easement and right-of-way herein <br /> <br />granted. <br /> <br />It is further agreed that Grantor con\feys their rights and interest in 5aid real <br /> <br />estate for the above described easement and right-of-way; and that Grantor on behalf of <br /> <br />itself, all heirs, executors, administrators, successors, and assigns, hereby covenants <br /> <br />that the rights and privileges herein granted shall be binding upon Grantor, all heirs, <br /> <br />executors, administrators, successors, and assigns. <br /> <br />- 3 - <br />
