<br />Affiant, CAROLYN C. NAHORNY, after being first duly sworn on
<br />oath, deposes and states as follows:
<br />1. That Affiant is the surviving spouse of ALEXANDER M.
<br />NAHORNY, who died May 22, 2005, as shown by the certified copy of
<br />the Decedent I s death certificate attached hereto as Exhibit "A"
<br />and by this reference incorporated herein; that Exhibit "A" is a
<br />certified copy of the original Certificate of Death on file with
<br />the Bureau of Vital Statistics, Department of Health, State of
<br />Nebraska.
<br />2. That Affiant and the said Decedent were husband and wife
<br />on the date of the Decedent's death on May 22, 2005, and were, on
<br />said date, the sole owners as joint tenants, not tenants in
<br />common, of the real estate legally described as follows:
<br />
<br />A Part of LOT FIVE (5), ISLAND, IN SECTION TWO (2),
<br />TOWNSHIP TEN (10) NORTH, RANGE NINE (9) WEST OF THE
<br />6TH P.M., more particularly described as follows:
<br />Beginning at a point on the South line of said Lot
<br />Five (5), which point is 644.0 feet East of the
<br />S.W. corner of said Section Two (2); running thence
<br />North 14054'East, 785.6 feet, to the present river
<br />bank line; running thence South 56044' West, along
<br />the present river bank line, 135.0 feet; running
<br />thence S. 43040' West, along the present river
<br />bank, 191.5 feet; running thence South 19028' West,
<br />along the present river bank line, 398.4 feet; running
<br />thence South 28003' West, along the present river
<br />bank line, 197.1 feet, to the Southwesterly corner
<br />of said Lot Five (5), which point is 369.0 feet, East
<br />of the S.W. corner of said Section Two (2);
<br />running thence East, along the South line of said
<br />Lot Five (5), 275.0 feet to the place of beginning,
<br />containing 3.40 acres, more or less
<br />
<br />3. That by reason 9f the provisions of the Joint Tenancy
<br />Warranty Deed, Affiant became the sole owner of the above
<br />described property on Decedent's death.
<br />4. That this Affidavit is given as evidence that pursuant to
<br />Neb.Rev.Stat. Section 77~2003, no inheritance tax lien arising due
<br />to the death of the Decedent can attach to the above described
<br />real estate and that pursuant to Neb.Rev.Stat. Section 77-2012, no
<br />Nebraska estate tax lien arising due to the death of the Decedent
<br />can attach to the above described property.
<br />FURTHER AFFIANT SAITH NOT.
