Kosiski, being first duly sworn upon oath, deposes and states that he <br /> <br />is President, a Manager, and a Member of Komer, LLC, a Nebraska limited liability <br /> <br />company. <br /> <br />Affiant further states that with reference to the Temporary Easement Agreement <br /> <br />executed on September 19,1997, between David L. Nelson and Beth D. Nelson, <br /> <br />husband and wife, as Grantor, and Ronald Vlach and Linda Vlach, husband and wife, <br /> <br />as Grantee, recorded as Instrument No. 97-107889 in the office of the Register of <br /> <br />Deeds of Hall County, Nebraska, on September 24,1997, that said Temporary <br /> <br />Easement Agreement has expired by virtue of the fact that all of the millings have been <br /> <br />removed from the real estate legally described as Lot 1 and the Northerly 40 feet of Lot <br /> <br />2, Garden Place Subdivision, Hall County, Nebraska. <br /> <br />Affiant further states that as of the date hereof, Komer, LLC, a Nebraska limited <br /> <br />liability company, is the record owner of the above described premises and is in <br /> <br />possession thereof. <br />
