TRUSTEE OF <br />THE LOUANN C PHIPPS REVOCABLE LIVING TRUST DATED OCTOBER 23.2001. AS <br />AMENDED. AND BY JAMES PIDPPS AND LOUANN C PHIPPS. HUSBAND AND WIFE <br />hereinafter referred to as "Borrower", and HOME FEDERAL SAVINGS AND LOAN <br />ASSOCIATION OF GRAND ISLAND, hereinafter referred to as "lender", <br /> <br />WIlNESSETH: <br /> <br />WHEREAS, Borrower did execute a certain Deed of Trost dated MARCH 15.2006. <br />filed of record on MARCH 23. 2006 in the HALL COUNTY REGISTER OF DEED'S <br />OFFICE OF HALL COUNTY, NEBRASKA in DOCUMENT #0200602474: described as: <br /> <br />A TRACT OF LAND IN THE NORTHWEST QUARTER (NW 14) OF SECTION TWENTY ONE (21), <br />TOWNSHIP ELEVEN (11) NORTH, RANGE NINE (9) WEST OF THE 6TII P.M., IN THE CITY OF <br />GRAND ISLAND, HALL COUNTY, NEBRASKA, AND MORE PARTICULARLY DESCRIBED AS <br />FOLLOWS: BEGINNING AT THE NORTHEAST CORNER OF LOT 1, BLOCK 4, PARKHILL <br />SECOND SUBDMSION, IN THE CITY OF GRAND ISLAND, NEBRASKA, THENCE <br />NORTHEASTERLY OF THE SOUTHERLY LINE OF ANNA STREET A DISTANCE OF 126.5 <br />FEET; THENCE SOUTHEASTERLY ADSIT ANCE OF 132 FEET TO A POINT ON THE <br />NORTHERLY LINE OF AN EXISTING EASEMENT, SAID POINT BEGINNING A DISTANCE OF <br />125.9 FEET NORTHEASTERLY FROM THE SOUTHEAST CORNER OF SAID LOT 1, BLOCK 4, <br />PARKHILL SECOND SUBDIVISON; THENCE SOUTHWESTERLY ON THE NORTHERLY LINE <br />OF SAID EXISTING EASEMENT A DISTANCE OF 125.9 FEET TO THE SAID SOUTHEAST <br />CORNER OF LOT 1, BLOCK 4, PARKHILL SECOND SUBDIVISION; THENCE <br />NORTHWESTERLY ON THE EASTERLY LINE OF LOT 1, BLOCK 4, PARKHILL SECOND <br />SUBDIVISION A DISTANCE OF 135 FEET TO THE POINT OF BEGINNING. <br /> <br />WHEREAS, such Deed of Trust does not contain a provision regarding a right to future advances <br />to be secured by such Deed of Trust; <br /> <br />WHEREAS, Borrower has requested that Lender make an additional advance to be <br />secured by such existing Deed of Trust; <br /> <br />WHEREAS, Lender is willing to make an additional advance to be secured by such Deed <br />of Trust provided there shall have been no filings of record subsequent to the date of the <br />recording of that Deed of Trust hereinabove identified; <br /> <br />WHEREAS, Borrower and Lender hereby desire to amend the existing Deed of Trust <br />identified hereinabove to provide that it shall continue to secure the presently remaining <br />indebtedness and the additional advance and future advances from and after the date hereinafter <br />specified; <br /> <br />NOW, THEREFORE, it is agreed: <br /> <br />1. Incorporation of Future Advance Riahts. From and after the date of the execution <br />of this Deed of Trost Modification Agreement, the indebtedness secured by the <br />Deed of Trust described hereinabove shall secure advances made concurrently <br />herewith and future advances in accordance with the following provision which <br />shall hereafter be deemed to be a part of such Deed of Trust: <br />
