<br />Danny Starostka, duly elected President of Starostka Group Unlimited, Inc., a Nebraska
<br />corporation" being first duly sworn upon oath, deposes and says:
<br />
<br />1. He is the duly elected President of Starostka Group Unlimited, Inc., a Nebraska
<br />corporation, and as said President verifies this account in writing for and on behalf of said
<br />corporation.
<br />
<br />2. Starostka Group Unlimited, Inc., by and through its duly authorized oflicers, entered
<br />into a contract with Kerry Hurter and Vicki Hurter, to provide labor and material for the
<br />construction of a new home and punch list items upon the real estate hereinafter described and
<br />the contract price for the improvements to be constructed upon such real estate by Starostka
<br />Group Unlimited, Inc. including change orders through January 24, 2007 is Two Hundred Forty-
<br />One Thousand Eight Hundred Sixty-Nine and 75/100 Dollars ($241,869.75).
<br />
<br />3. The labor and materials provided is upon and in respect to that real estate located at
<br />319 Ponderosa Drive, Grand Island, Nebraska, being a part of that property legally described as
<br />follows, to-wit:
<br />
<br />Lot Four (4) Block Three (3), Ponderosa Lake Estates Fourth Subdivision,
<br />an addition to the City of Grand Island, Nebraska.
<br />
<br />4. The amount unpaid and due to Starostka Group Unlimited, Inc. for materials and
<br />services provided in accordance with the invoices and change orders through January
<br />24,2007 is Seven Thousand Three Hundred Twenty-One 38/100 Dollars ($7,321.38)
<br />together with interest in the amount of Two Thousand Thirteen and Noll 00 Dollars
<br />($2,013.00) through April 10, 2007 and further interest thereon as provided by
<br />applicable law.
