FRANKS, being duly sworn upon oath, deposes <br />and states as follows: <br />1. That he is the son of Ruth M. Franks, who died on <br />December 11, 2006; <br />2. That he was named as the Personal Representative in the <br />Will of the Decedent, although no estate has been or will be <br />filed for the reason that the Decedent had joint ownership of all <br />of her property, specifically she jointly-owned her real estate <br />with her daughter, Julie A. Smaha, and jointly-owned her bank <br />accounts with the undersigned Affiant; <br />3. That your Affiant is in the process of the preparation <br />of an Inventory and Petition for Determination of Inheritance <br />Tax; when the amount of inheritance tax is determined, your <br />Affiant will pay said inheritance tax out of the funds owned <br />jointly with the Decedent; <br />4.
