<br />encumbrances, except for: a certain Deed of Trust dated November
<br />12, 2003 and recorded on November 14, 2003, as Instrument No.
<br />0200314966 in the records of the Office of the Register of Deeds,
<br />Hall County, Nebraska; an Assignment of Rents dated November 12,
<br />2003 and recorded on November 14, 2003, as Instrument No.
<br />0200314967 in the records of the Office of the Register of Deeds,
<br />Hall County, Nebraska; and easements and restrictions of record;
<br />
<br />(2) have legal power and lawful authority to convey same; and
<br />
<br />(3) warrant and will defend title to the real estate against the lawful
<br />claims of all persons.
