McCallay and Christine L. McCallay, are the <br />Defendants, Deutsche Bank f/kJa Bankers Trust Company of California, N.A., not in its <br />individual capacity but solely as Trustee or its permitted successors and assigns, on behalf of <br />Vendee Mortgage Trust 1999-3, by and through its loan servicing agent, Countrywide Horne <br />Loans, Inc., did obtain a Decree finding that there is due from Sammy E. McCallay and Christine L. <br />McCallay to Deutsche Bank f/k/a Bankers Trust Company of California, N.A., not in its <br />individual capacity but solely as Trustee or its permitted successors and assigns, on behalf of <br />Vendee Mortgage Trust 1999-3, by and through its loan servicing agent, Countrywide Horne <br />Loans, Inc., the sum of Fifty-Four Thousand Eight Hundred Seventy and 81/100 Dollars <br />($54,870.81) plus interest and costs of suit; and <br /> <br />WHEREAS, it is further ordered in said Decree that in default of the payment of the sum so <br />found due by the said Defendants, that Ll-Je Hali County Sheritt~ should cause the lands and <br />tenements hereinafter described to be advertised and sold according to law to pay the same; and <br /> <br />WHEREAS, default having been made therein, the said Hall County Sheriff, under and by <br />virtue of the said Decree and the Order of Sale to him duly directed, did on February 21,2007 at the <br />Hall County Courthouse in the City of Grand Island, in said County of Hall, having first given due <br />and legal notice of the time and place of said sale by publication once in each week for four <br />consecutive weeks in a newspaper printed and in general circulation in said County of Hall, sell said <br />premises at public auction to Deutsche Bank flk/a Bankers Trust Company of California, <br />N.A., not in its individual capacity but solely as Trustee or its permitted successors and <br />assigns, on behalf of Vendee Mortgage Trust 1999-3, for the sum of Forty-Five Thousand <br />Five Hundred Twenty-Four and 00/100 Dollars ($45,524.00). The sale was afterward on March <br />15,2007, examined and confirmed and the Hall County Sheriff, ordered to convey said premises in <br />fee simple title to Deutsche Bank f/k/a Bankers Trust Company of California, N.A., not in its <br />individual capacity but solely as Trustee or its permitted successors and assigns, on behalf of <br />Vendee Mortgage Trust 1999-3, its successors and assigns, purchaser at sale. <br /> <br />NOW, THEREFORE, I, ~fltfl f tV I7-TsC/'YI . , Hall County, Nebraska, <br />Sheriff, in the County of Hall County, State of Nebraska, as aforesaid, in consideration of the <br />premises and by virtue of the powers vested in me by law and the Decree of said Court, do hereby <br />give, gr~t and convey to Deutsche Bank, flk/a Bankers Tnisf'C61tipatl)'"of Califomia, N .A., not in <br />its individual capacity but solely as Trustee or its permitted successors and assigns, on behalf of <br />Vendee Mortgage Trust 1999-3, its successors and assigns, the premises as aforesaid sold, to-wit: <br /> <br />Lot 8, Block 6, Wallich's Addition and its complement Lot 8, <br />Block 21, Fairview Park Addition, all in the City of Grand Island, <br />Hall County, Nebraska <br />
