<br />Notice of default and election to sell is given by Joseph H. Badami, Attorney for
<br />Trustee, in accordance with the procedure set forth in a certain Deed of Trust dated March
<br />18,2005 wherein COONEY PROPERTIES, INC., a Nebraska Corporation, is designated
<br />as Trustor-Borrower, TIERONE BANK, a United States Corporation, is designated as
<br />Trustee and Beneficiary. Said Deed of Trust was filed for record in the Office of the
<br />Register of Deeds of Hall County, Nebraska on March 29, 2005 as Instrument No. 2005
<br />02655. Said Deed of Trust grants to TierOne Bank, Trustee the power of sale over the
<br />following described real estate:

<br />Further Joseph H. Badami, Attorney for Trustee, states that the said Trustor-Borrower
<br />has breached an obligation of said Deed of Trust by failing to pay the monthly payments of
<br />principal and interest of One Hundred Sixty-Nine and 53/100 Dollars ($169.53) for the
<br />month of September, 2006 and principal and interest of Six Hundred Sixty-Nine and 53/100
<br />Dollars ($669.53) for the months of October, November, and December, 2006 and January,
<br />February, and March, 2007 plus late charges. As a result of this breach, said Beneficiary
<br />has elected to exercise the power of sale and to sell or cause to be sold, the aforementioned
<br />property to satisfy the obligation of the Trustee.
